Hello everyone,

I'm so glad I found this site. I'm sort of at a loss. Here is my story. I met my husband when he was an international student in the US. He then graduated and went back to South Korea. Before he left he proposed. At the time we had the option of getting married while he was still here, but he didn't want my parents to think he was just marrying me for a visa and wanted to take the proper channels so he went back to South Korea so I could apply for a fiance visa for him. While he was there our relationship got rocky and I waited to apply. Two years went by as we were working on our relationship. He came to visit in February of 2009 and which time he stayed for about 3 months (S. Koreans are now allowed to enter the U.S on a tourist visa for 90 days). We finaly decided to get married. I went to Korea to visit and also to take him to visit m parents on Guam to "get permission". When we got to Guam he got held up at immigration, then sent back. They said he had stayed in the US illegally, which was not true. They didn't have record of his student visa. I was told that getting a fiance visa for him would be very difficult by the immigration people. So we went back to Korea and decided to get married at the US Embassy so that I could file a I-130 for him. I'm now looking at the application and it asks for the last address we lived together. We did lived together for awhile when he was in the US as a student and while he was visiting in February, when we decided to get married, we got an apartmnt together before he left to go back. OUr names are both on the lease. But we've only been renting since February 2009 when he came to visit. Is this the address I enter in this field? I was told that as long as I included a copy of his student visa as proof that he was not here illegally I would be okay. I do have it. Does anyone have any information regarding this? I"m sorry this is so long, but any information would be greatly appreciated. I really miss him and want to get him home as soon as I can.

yes, you can provide this address, no problem. Also, it seams that you are now staying in Korea...do you live there together? - if yes, you need to provide that address. Just write the last address that you realy lived together even for one day ,and its all be fine. Trust me that whatever u answer, will not get you in trouble.

No I am not in Korea. I really wanted to stay, but I had to come back. So it's okay to put the address of the apartment we got together when he was visiting in February? And for the dates I can put the dates he was here for?

Would I include the lease for that apartment and also the joint account we opened at the time as proof of marriage too?

i would include the papers but usually in most cases the two people have never lived together (just visits) so in that fact your good and ahead one step

That doesn't matter, as long as you have a doc showing you've both been living there and renting this apartment together, sending a copy of your lease would be fine. When you visited S.Korea, did you register with the Immigration police on his S.Korean address? If yes, then you could also include a copy of your address registration in S.Korea. This is what we did with my husband. Every time he visits Bulgaria, we always register him with Immigration police on my address (the law requires it).

I got it as a tip from other VJ members, who've been in USA on a J-1 and F-1 visa. That helped me a lot and it also prevented us from getting any RFE's related to my stay and status in USA. I've been in USA on a J-1 twice and my last visa in USA was F-1, but the F-1 visa I actually never had it stamped in my passport, as I changed status while in USA on other type of visa. However, with sending the DS-230 + original documents, we also included in the package all copies of my previous visas in USA + DS-2019 (this DS is very important). If he went to USA on a student visa, he should have this DS. If not, together with the copies of old visas in passport, he could attach a letter with an explanation. Besides the copies of my visas, and copies of DS-2019's I included a letter explaining my visits and stays in USA. Nothing to worry about, really, if he never stayed illegal in USA!

I"m sorry this is so long, but any information would be greatly appreciated. I really miss him and want to get him home as soon as I can.
