I am a permanent resident and have filed an I-130 petition to sponsor / get my daughter here.

She is over 21 and not married. (Category 2B)

I filled the petition in June 2006 and got notice that it was approved a few days ago.

The paperwork says that she will be contacted within 90 days by the SA Consulate in JHB.

This approval was a big surprise - the visa bulletin website says that they are oversubscribed and that they only have immigrant numbers available for persons with a filing date prior to April 2001.

Her priority date is July 2006.

Can anyone help with the following questions:

1 - Why was this approved so quick and years before we expected her date to come up?

2 - How long will the rest of her application take?

3 - How does the rest of the process work now?

4 - Do they now issue a green card or not - if not what

5 - What is a possible date that she will be able to move here legally with the required paperwork?

I will appreciate any help / info / advise on this.

This was the approval of the I-130 correct? Now it goes and sits on the NVC side until the visa number is available which is in about 5 years :(

However is AARON2020 logs in he will answer this a little fuller cause he is always spot on for these

Approval is just the first step. It will be another 5 years before your daughter will be eligible for a visa.

The immigration visa process;

1. Approval of the I-130 by USCIS.

2. Approved I-130 waits at the NVC until the PD becomes current in the Visa Bulletin.

3. Pay AOS & Immigration Visa fees.

4. Submit AOS & IV forms with supporting documents.

5. Consular processing (interview).

Your daughter is now in Step 2. The F2b category is oversubscribed. Only when her priority date (PD) becomes current will she be eligible for a visa.

I filed for my "over 21 year old" son back in 2005. His I-130 was approved early last year. The I-130 is sitting at NVC waiting for a Visa to become available. I did become a USC last March and had the catagory changed from F2b to F1 so it will cut down the wait by a few years. We are not expecting to hear anything from NVC for at least another 2+ years.

You have a long ways to go yet.

I am new to this forum, I am in a similar situation to the last person that replied and I was wondering if you guys can help me!

I am originally from colombia, my dad sent an i130 application for me in march 2005, my category was 2A because back then I was 19 years old.(born in August 1985)

March 2005 application was sent (my dad was a LPR)-category 2A

August 2006 I turned 21. ( i130 application was still pending)- category 2B but because i130 pending still 2A

August 2008 my Dad became a citizen ( i130 application was still pending) from 2B to 1st category

March 2009 my i130 was approved. approved as a 2A

so technically it was pending exactly 4 years from march '05 to march '09...4 years that I can subtract from my age right?

current bulletin says they are processing 2A category applications from january 05...then i would think that in a couple of months they will get to march 2005 which is when my dad applied. 2A is much faster that 1st category right now.

so my question is if by the time the the visa becomes available for the category 2A that i originally was....does the CSPA apply to me even though my dad became a citizen? can I move from 1st category back to 2A? because technically with my age adjustment I would still be under 21

I posted this on another topic but think it can applied to this one as well

can you guys help me out here?
