Hi all,

I am in the process of filling in all my papers for AOS. I've been browsing trough this great forum for a few days now, and have been able to find answers to most of my questions. However, I'm still not sure about a couple of things on my I-485.

I entered on a B2 visa, got married within the duration of my I-94 which has now expired, and I am currently out of status and filing for AOS.

If you have applied for AOS successfully with similar circumstances, would you please let me know what you put under A. Part 2 'application type' tickboxes a-h, and B. 'current USCIS status'

First did you marry a citizen?

When we filed for my husband in 2007 ( he overstayed since 2001 on B1/B2 visa ) we checked box A. Make sure you file the I-130 along with the I-485 and I-765. even if you apply for the Ap I-1313 do not use it as you are out of status and will have a hard time getting back in the US if at all. You will need to wait for your GC to leave the US. Your current status will be I-130 pending

Oldest son now 21 I-130 filed by LPR dad ( as per NVC CSPA is applying here )

Priority date 12/6/2007
4/6/2010 letter from NVC arrives to son dated 3/4/2010
5/4/10 received AOS and DS3032 via email
9/22/10 Interview BOG Passed
10/3/10 POE JFK all went well
11/11/10 GC Received smile.png

We were VWP rather than B2 but I think the same applies - if it doesnt I am sure someone will correct us. You are now married yes?

That is what I would put.

USCIS can see your out of status, but as long as there are no "adverse factors" in your case, you need not worry.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.
