Travelling for the first time with Conditional Permanent Residency

I know this topic has been brought up before, but I thought I'd start a new thread. Tomorrow night, my husband, sister and I are travelling from the USA to the UK to visit his family for a week. This will be our first time travelling since he received his greencard this past March.

I know he'll be fine for re-entry, but I still can't help but feel nervous. The only things we need are his passport and his greencard (which he carries everywhere with him anyways), correct?

Thanks.

hmmmmm, will she click through? :)

A Permanent Resident of the United States can travel freely outside of the US. A passport from the country of citizenship is normally all that is needed. To reenter the US a Permanent Resident normally needs to present the green card (Permanent Resident Card, Form I-551) for readmission. A reentry permit is needed for reentry for trips greater than one year but less than two years in duration.

Um, thanks but the sarcasm (if that's what you're trying to pull off) really isn't necessary. I've read their site and I've read past threads. However, I've also encountered trouble at the airport before, and read other threads where people have still had some kind of issue at Customs. I didn't know if I should bring anything additional, such as our marriage certificate or any other documentation as a precaution, and wanted feedback from others. I'd like to be prepared and breeze through Customs and Immigration.

If that wasn't your intention, then please excuse the first comment.

Anyone can have customs problems. Even USCs. My wife left the US and returned without problems with just a I-551 stamp in her passport.

Customs and immigration are 2 separate things.

  • 2 weeks later...

Well, we got back in the USA this past Sunday. Obviously, no problems going out, but we did have a problem coming back in. When my husband went through Immigration, they flagged him, told us to collect our luggage, and go to another inspection area.

My husband had a turnaround in 2004 due to an alleged overstay. I say alleged, because we and our laywer have counted the days ourselves, and he did NOT overstay, yet it remains on his record, and was the reason why he was flagged on Sunday. We waited in the inspection area for about 15 minutes, they called his name, and told him he was free to go. We asked about why he was flagged, they explained that it was because of his previous turnaround, and that depending on the experience level of the officer, he or she will recommend for a second inspection. We told him we were concerned with him being denied entry, and he told us that that while the greencard does not strike the overstay from the record, it does overcome it, and as long as my husband is a greencard holder, he will never be denied entry.

I told the officer I was going to hold him to that. It's a little upsetting to know that this could happen everytime. Perhaps it doesn't seem like such a big deal, like more of an inconvenience, but that first time he was sent back was the worst night of our lives, and to have to relive it quite unnerving, especially after all we've done to be together legally.

Just thought I'd share because I've seen others post about greencards with overstays.
