i absolutely love this site! so much information and help. thanks in advance!

both my American husband and i are in the initial stages of the i-130 form and although i have searched for sample Affidavits i'm curious to know how much details should be described by my third party affidavit who happens to be my mother as well she was present at the ceremony. is having her describe the ceremony required? any suggestions from those who had their witnesses as the third party affidavit are greatly appreciated as well :)

The affidavit is not to verify that the ceremony took place, but rather to support the petitioner's claim that you are living as a married couple, etc.

I supplied 3 affidavits with my I-130 application. One was from my husbands friend who attended the wedding it basically just verified that we were married on such and such date and how he knew my husband. The second was from the legal witness (in Senegal one must have a Senegalese citizen witness) he just stated what his position was in the wedding. The third was from my mother who did NOT attend the wedding but took care of my children while I was out of the country and hers stated that she had seen the wedding certificate and it appeared to be valid.

I don't know what the previous poster is talking about because my husband and I have never lived together, I have visited for a total of 32 days. If you check out my timeline you will see that we went through each stage of the process rather quickly with NO hang-ups whatsoever. We are right now just waiting to be assigned an interview and then I will make another trip to Africa to go to the interview and then bring him home with me.

your affidavits along with most of what i've seen seems to be matter of fact "on such and such date...". so i will just get the third parties to stick with the facts as opposed to descriptions of the ceremony.

All of mine also included their date and place of birth, phone number, email address and physical address. My mom had her's notorized.

Just wondering if someone could provide some insight:

After reading some of the threads on this site relating to affidavits from third parties evidencing the bona fides of the marital relationship (as per the instructions on the I-130), is it required that my husband, who is a U.S. citizen, has to swear an affidavit as well? All of the affidavits I have prepared thus far are sworn and notarized by U.S. citizens who were present at our marriage in Calgary, Alberta, Canada. Is that enough?

Thanks - what is included in our affidavits is a description of:

1. An overview of the progression of my and my husband's relationship to the point of our marriage on March 28, 2009;

2. Firsthand accounts of what the affiants observed about our relationship/actions when they saw me and my husband together (mainly before the marriage);

2. That the affiants were present at our marriage ceremony and wedding reception

3. That my husband and I have been residing together in Canada since the wedding.

Is it sufficient enough for his mother, who lives in the U.S., to state in her affidavit that she knows with absolute certainty that my husband and I are living together as we maintain regular contact with her?
