I need to ask this question but to give you a breif of what is going on with our case. We filed for a I129F in November of 2008 and went to the consulate in Athens on 5/18 they received it. But...my fiance had a call from his family he had to go home to be with his mom she is not doing well. So off to egypt he goes. The embassy, thank God, took our case to finish there. They received it 6/28. My questions are two:

1- When he went to get his police records from the two countries that he lived in, both told him if he has anyone in that country that can get it for him would cost him alot less time. They told him copies of what documents and like that. She said they could do it at the embassy but would take 2 months or more. Can a friend do it for him???? I am in USA is just strange to me but if they can GREAT!! If anyone knows of time lines...ya know the same question we all ask..even a guess would be great.

2- Our NOA2 expires 8/1/09 do i need to request for it to be extended and to who do I ask?

Thank you so much

Theresa

1) It depends on country, some require power of attorney from the person getting the report. What countries are we talking about?

2) Most consulates automatically extend the validity of the I-129F NOA2. There is a sample document in the example forms here on VJ that you can use to request an extension.

Contact the embassy that has your petition and ask for an extension.

I doubt a friend can get police reports for someone else (private information and all that).

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

WARNING: Phrases in this post may sound meaner than they were intended to be. Read the Adjudicator's Field Manual from USCIS

The countries are Greece and Lebanon. He went to both today and they both told him the same thing. Thank you for the form to request extension I'll do that.

Again thanks so much

To apply for K-3 you need to file I-129F to USCIS with a copy of I-130 Receipt letter, and before I-130 is approved.

Why would you want to do this now? There is NO way that the K-3 petition would make it to the consulate before you interview for a CR-1 visa.

About original docs, you do NOT file them with I-130, you later file them to NVC when they ask for them. You will need to get certified copies from the appropriate authorities so that you can send them to NVC for processing.

thank you . hello I oready have approvel for both

Keep in mind if you do K-3 and abandon the I-130 process at NVC you will also be throwing the $470 spent away and be paying another $1010 to adjust status in the USA.

You have already paid the $470 for immigrant visa which will result in a green-card the moment you enter the USA, I would stick to this process.
