Timeline

I started my full time job in October as I graduated from college, so till October I was only working part-time. Currently my annual income is well above the poverty line, so my question is should I have someone file a Joint Sponsor I-864 or will I be ok with being the sponsor? :wacko:

I would have thought that would be dependant on the income tax return you filed for the last year..

If you can get a joint sponsor it wouldnt hurt :thumbs:

Thanks, I think I will have a joint sponsor just to be on the safe side, since I only started working full time in October of last year.

Get a letter from your employer stating how long have you worked here and what your current salary is, current bank statements will reflect current cash flow too. I think you should be fine. but it's always good to be on a safer side and have a plan B:)

Usually, if your current annual income exceeds the guideline, they will not take a J-S's I-864(a) just because you want to give one.

They will accept one if they ask for it... So you can prepare a J-S to fill one out, but wait to be even asked for it...

my worry is that I just started the full time job in October, so it hasn't been even 1 year, so I just wanted to be on the safe side. Will it be a problem if I send the JS in anyway without them asking?

I can say what I hope they would do, but I'm not sure what they will actually do.

I guess I hesitate to submit one since you appear to meet the guideline, and submitting one might put someone legally "on the hook" when it's not needed...

I-864 and supporting documents: (you might want to include with the taxes.. for this current year : paystubs, bank statements, and definitely an employer letter to show the permanent, full time salary).

I'm sure that others will have valid arguments to just send it in...

You can call and ask a live operator at NVC. If your income is above the poverty level, you don't need a co sponsor. Please read the poverty guidelines from the following link:

It took 92 days for I-130 to get approved from the filing date

NVC Process of I-130:

It took 78 days to complete the NVC process

Interview Process at The U.S. Embassy

Interview took 223 days from the I-130 filing date. Immigrant Visa was issued right after the interview

You may or may not be OK on your own - it depends on how comfortable the consular officer processing the visa application feels about your ability to maintain your present income in the future. Might depend on who your employer is and what they say in the letter of employment.

I agree with what I understand zixuandavid to have suggested - have an I-864 package from a Joint Sponsor available to turn in if one is asked for.

An NVC operator isn't going to be able to give a correct answer to this question except by coincidence.

- the NVC staff don't evaluate I-864, consular officers do. The NVC staff simply makes sure that the I-864 package contains all the documentation that it's supposed to contain.

- NVC phone people don't even do that much, they answer phones.

I agree with this..

Whether you send one I-864 (because you think your covered) or two (also send a J-S one to cover yourself), it will probably just get put into the case for the consulate to evaluate... At this point, at the interview is where you could get a request (or not).

one item to pay attention to is if a I-864a is used (household member)... Any request for something needed OR not needed will affect both forms.

if you file one I-864 with no household members then find out at the interview they want a J-S from you.. then you should fill out a new one yourself with the person as a HH member; and they do a I-864a.

if that person is not a HH member, then a new I-864 from the J-S is enough...
