You didn't answer Yodrak's question entirely: when did she leave?

the two year rule starts from the day she left the US to go back to her last legal permanent residence country. The last legal permanent country should be stated either on the DS2019 or the annotations of the J1 visa.

She got a tourist visa because this kind of visa doesn't fall under the restrictions of the two year rule, just like the F visa. But the K1 does...

She has to be physically present in the last legal permanent residence country stated on the DS019 if available or the country in the J1 annotations for at least 2 years before she is eligible to get a K1 visa.

AOS JOURNEY:

September 13TH 2006 NOA1 for EAD and Adj of Status

September 23rd Biometrics notification by snail mail

September 27th RFE : Cosponsor needs to send more proof of his business activity

September 29 th RFE sent to Lee's summit

October 6th : Biometrics.

October 9TH:"RFE delivery refused!!, not enough postage available!"

October 16th : RFE finally delivered after second try!

October 18TH: email notification RFE received! Finally updating things online?

October 30TH: Transfer to CSC!!! Wohoo!

November 2th: CSC received case;online notification!

November 8TH 2006: AOS APPROVED!!!! Vive California!!! 5 days to get approved!Online notification

November 14 2006: GC or should I say White card arrived in the mail!!! I checked my mail only on the 15th

LIFTING CONDITIONS (Nebraska/California)

August 04th 2008: Mailed package directly to California

August 18th 2008: NOA1 date

September 10th 2008: Biometrics

September 11th 2008 : Touch

December 6th 2008: Approval Notice

Yodrak is right, you start counting 2 years from the date she left the country. I was on J1 visa myself and wasn't sure if the 2-year rule applied to me or not. I sent and inquiry to Department of State (for so called an advisory opinion) and they sent me an official letter saying that I am not subject to the rule. But since your fiance's interview date is so soon, most likely you won't get an answer on time (it took them 6 months to answer my inquiry :blink: )

September 27, 2006 - Biometrics appt letter recieved

October 5, 2006- Biometrics taken

October 10, 2006 - both I485 & EAD touched

November 1, 2006 - I485 touched

November 21, 2006 - still waiting ......

December 7,8,9 - touched

December 11, 2006- approval notice via email

December 15, 2006 - EAD arrives in mail with the wrong dates (03/21/07-03/20/08)

December 18, 2006 -InfoPass re: wrong dates (fixing the card will take another 90 days...)

January 13, 15, 2007-both I485, EAD touched

February 25, 2007 - Initial interview letter recieved in mail

April 18, 2007-Interview!

May 7, 2007- Approval notice sent

May 11, 2007-Permanent Residency Card arrived in mail

February 2, 2009- I -751 filed

February 6, 2009- NOA received

April 8, 2009- I 751 approved!

June 20, 2009- GC received

I know that sucks :( You just have to do all your research for this process. It's strange though. MY husband had five J-1 visas...they immediately sent us an RFE asking for copies of the J-1's...that was the FIRST communication we got from there...to see if there WAS that rule or not..

Finally finished with immigration in 2012!

Sorry about that - I had meant to say she left on Dec 13th 2004. Its not looking good. Thanks for all the replies. This really has cought me offgaurd.

Hold on... she was in the US as a J-1 for ONE (1) month, and has a 2 year HRR? That seems awfully steep.

Did you read the visa carefully? Are you positive that she *does* have the 2 year HRR?

Even if used for a short period of time, if the J-1 is used in a certain way, the 2 year rule applies. It is VERY clear on the VIsa...big print, hard to confuse. That was, at least, what I heard about it after inquiring about STewart's J-1's...

Finally finished with immigration in 2012!
