Hi Guys!

My boss keeps telling me that she wants to keep me on staff on sub-contract when I move to the US ( 99% of my work is online, so I can work from anywhere with internet access). So, legally do I have to wait for my EAD to work for a Canadian company after I immigrate? or can I just keep working for a Canadian company while living in the US before I get my EAD? I would be paid in CAD and it would go into my Canadian Bank Accounts.

Thanks in advance for your always great advice!

I was told by my green card interview giver that this was perfectly and 100% legal. I told him I had been doing this for about 2 years - and he said "Okay." and stamped the paperwork. He let me know that is legal and will not interfere with the EAD/work issue in the USA. They also understand you can't just NOT work during this process.

I checked with other people in the same position, talked to Infopass and everyone said this is NOT a problem and you are okay to do it.

I am confident saying: Yes this is legal, and go for it.

Agreed - your EAD has to do with work authorization in the USA, not Canada. You don't lose your ability to work for a Canadian employer by moving to the US.

Happy to help. I know its in our nature (for some reason everyone here is a worrier) to worry about every minute detail and rehearse all of our options and ideas for interviews, border crossings etc. However the CDN job is nothing to even add to your list of concerns. So try to let that bit slip so you can be neurotic about something else in its place.
