Filing I-129F without NOA1...?

Hello everyone!

Maybe one of you can enlighten me with the following questions:

1. Is it possible to file the I-129F without receiving the 1st NOA?

2. What constitute evidence that I have filed form I-130 (IE... Notice of Action Form I-797C, cashed check)

Read form I 129F Instruction and I can not find clear guidance within the form (Why Am I Not Surprised?).

If I was you, I'd follow the flowchart: http://www.visajourney.com/forums/index.ph...amp;page=k3flow. If you don't, who knows what could happen to your petition but if you're willing to take that chance & have the process take EVEN LONGER, then go ahead and submit the I-129 paperwork. I don't think there is any real instructions as it is used for K3 and K1 petitions. From what I read:

"USCIS has been administratively closing the I-129F upon approval of the I-130. USCIS, however, is currently reviewing the I-129F/K-3 process."

If I was to do it all over again, I wouldn't have gone the K3 route. That 6 month window starts the day of your NOA1 from your I-130...if you submit the I-129F, the process basically starts all over again. It is your choice though. Good luck!

Hi PlatanoKIng.

You need to attach either a photocopy of the Transfer Notice of your I-130 OR the NOA1 of your I-130 (which is also the I-797C) before you file the I-129F. You can't send the I-129F in with just proof that they cashed your check...the Transfer Notice or the I-130 NOA1 are more significant forms of proof.

The VJ Guides on filing a K3 application is pretty straightforward. My husband and I found it very useful while preparing the I-130 petition. :)

The Federal instruction guides on an I-129F (the one you download from the USCIS website) tell you how to use that form when you are using it for a K3/K4 application...but not quite...we still relied on the VJ Guides for help.

02-23-2018: Date on Biometrics Appointment Letter (Biometrics Appointment at Jacksonville ASC on March 13, 10:00 a.m.)
