EAD Question

I filed for AOS and recently got a RFE for my birth certificate. In the letter, they wrote "You are ineligible for interim employment authorization pursuant to Title 8, Code of Federal Regulations, Section 103.2(B)(10)(ii) until ninety(90) days after the missing initial evidence is received.". From what I could understand, I'm not allowed to work until 3 months after I send them the missing evidence. The problem is, when I arrived (on a K-1), I made the mistake of applying for an EAD BEFORE GETTING MARRIED (man I wish I knew this website before doing a lot of things), and it took more than 90 days to get a response from them. So I set up an infopass appointment and got an EAD valid until Feb 2007. Is my EAD worthless after getting the RFE? Could I get in trouble for trying to work using this EAD?

BTW, That happy face wasn't in their letter. I don't know how it got there.

The VJ software automatically converts certain character combinations involving parentheses, combinations that are common 'smilies', into emoticons. The text you quoted contained such a combination.

I think your current EAD which you filed for under your K1 is only good until your I-94 expires. Since you applied for AOS, you would need to apply for a new EAD under it.

The letter is basically saying that when they issued you an RFE, they reset the clock to another 90 days before you could go and apply for an interim EAD. Most EAD applications are approved within 90 days, so hopefully you won't have to worry about it.

I would say that paragraph is standard with most RFE's. Your current EAD should still be good.
