Well bak in March my fiancee was denied her K1 visa because lack or relationship and only 1 trip to vn. Now im try to go back in September so we can get married and apply for a CR-1 visa. Can some one please get me tips and things i need to do while im there to maximize my time over there. Thanks so much...

Be sure to allow enough time to get the needed paperwork for your marriage. Of course cash is king in VN, so there are ways to expedite the process.

Do a lot of reading in this forum and you will see the stories of those who were successful and those who failed. As you have been through the K visa, you understand how things go at HCMC.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

we had dam hoi last time over 300 people for the engagement party, since her family wanted one in vn before she went to america. I hope we dont need to do another one, we basically had wedding ceremony without documents so we could file the k1 n get her here faster but it failed. So what else to do?

here FYI

You have to do this

I assume the attorney you talked to in HCM was Marc Ellis. There is no better expert on the peculiarities of the US Consulate in HCM than Marc, as he has been involved in hundreds of cases there. He probably referred you to the law offices of Tran Hai Duc in HCM. They'll help drill your fiancee on some of the questions the CO might ask, but I suggest you help to prepare her in advance. It has become somewhat customary for VJ members with SO's in Vietnam to post the questions their fiancee's were asked in HCM after the interview. Go to the Southeast Asia and Pacific forum and search for the threads.

Some specific things they flag cases for in HCM are:

1. Not enough time between the first meeting and the engagement. This is contrary to local traditions.

2. Only one or two visits to Vietnam, or visits of only a few days each.

3. No engagement ceremony. A "dam hoi" or "dinh hon" engagement ceremony is customary in Vietnam. Have pictures available.

4. No pictures of petitioner with the family of the beneficiary. Engagement and marriage is a family affair in Vietnam.

5. Petitioner knows or was introduced by family of the beneficiary in the US.

6. Beneficiary doesn't know enough about petitioner. Seriously, they may ask her questions that an American wife of 20 years might not know. If the information is in the documents submitted, or on ANY public record the consulate has access to, then your fiancee should know this information.

7. No common language. If you don't speak Vietnamese, and she doesn't speak English, they are going to question the relationship.

None of these things will automatically result in a visa being denied by the consulate, but they should be addressed sufficiently in your documentation.

The CO's in HCM are well known to issue blue slips for additional evidence, and ask for documents which were never asked for in either "official" packet. The two most common are a timeline of your relationship, and a list of the beneficiaries family in the US. Again, look in the Southeast Asia and Pacific subform for specifics on these documents. Have them ready - don't make the CO ask for them.

Evidence - KEEP EVERYTHING

• Credit Card receipt for Airline tickets

• Airline ticket stubs

• Chat logs (print them out)

• Phone bills showing showing you called

• Hotel receipts in VN

• If you buy her jewelry, keep the receipts

• receipts for the engagement ceremony and party (dress rental, food, beer, cake, facility or restaraunt,car rental, band or dj, etc)

• Tax returns / transcripts - take 3 years

• pictures (you and her/him together / engagement ceremony (make sure they take pictures of all the guests)

• A list of ALL relatives your fiancé has currently living in the US (brothers, sisters, aunts, uncles, cousins. At least have the STATE they live in, we provided addresses and phone numbers.

• IF your fiancé happens to be pregnant - take copies of the ultrasounds

• A timeline of your relationship (this is VERY IMPORTANT - they will give you a BLUE SLIP without one) (send me an IM if you would like a copy)

MAKE SURE YOUR EVIDENCE IS SORTED IN CHRONOLOGICAL ORDER.

Yes, if you are also Viet you need to show all the family in the US for both of you.

If you were introduced by family members, that is another issue to address.

her father is in america an itroduced us, we got engaged after 5 months, im american, and only 1 trip to vn. i learned of all this after it was 2 late.. i used allen lolly an that was a total waste of money..... just trying to get things lined up for next visit n apply for cr1 i hear its better than k-3

let me tell you , doesn't mater you do K3 or cr1 you do not right ,need more evidence relalative to you family good luck best ask more Anhmap Jimeandphuong,Scott they can know a lot and they can tell you what going on.

Father/close family introducing you and then everything happening quickly is a HUGE red flag for HCMC. Be sure that you charge EVERYTHING so that you can document that you paid, not someone else.

There have a been a couple of people here on VJ that had problems at HCMC because they claimed to have paid cash and couldn't show who paid for the plane ticket, etc.

Use at least 2 cameras and take LOTS of pictures. 1 digital and throwaways also in case your cameras crash or are stolen. Download pictures to a safe place every day. Pictures are worth more than gold! :thumbs:

Stay as long as you can and try and make multiple trips.

I have done the same thing they failed my K1 so we got married and we filed a CR1. CR1 is better than the K3 it has a better chance to pass but you can file both, the K3 will be free to file if you do a CR1. I would file the CR1 first however and wait to send in the K3. I couldnt stay the 40 days it takes to do the paperwork so I made 2 trips of 2 weeks each about 2 months appart. The second trip when I picked up the marriage certificate we also had our honeymoon. I never filed for a K3 even though its free. Mr Ellis posted his twitter handle here so I have been following that and from what I read it seems you might be able to succeed with a K1 again.

Make sure you take allot of pictures of you two together and they are naturally happy pictures of doing stuff not just at the dinner table or eating out. I also support my wife so I would recomend to send her money every month nothing big maybe a few hundred so she can live off it and take some english classes. I use wellsfargo remittence account I can send up to 3,000 and I only pay a 4$ charge. I use VNlistings to call my wife its about 5 or 6 cents a minute we talk almost 45 minutes everyday on the phone. Send her emails everyday and when she replys print them out make sure to mail her a letter every week if not then once a month will do. 2 things above all 1. Make sure when you refile you address the denial of the K1. 2. Show up for her interivew. You do these things and it will be a slam dunk in your favor.

Are you planning to START CR-1. How long will you stay in VN to get your MARRIAGE CERTIFICATE?

Be Prepare for the following document in-hand before you arrives in VN.

1 - Cong Ham Doc Than = Single Status. For both

2 - Kham Tam Than = Mental Disorder checkup (Can be done in VN if you have time).

3 - Marriage Certificate need to sign from both of you. (Time require to stay in VN 4-5 weeks.)

For Wedding.

1 - Lot of pictures with different clothes with both you and her family.

2 - All evidence restaurant bills, vacation ticket (i.e. Dalat)

More and more, I can't thing of now. CR1 is easy once you get everything done from VN. Specially Marriage CERT. is very tough to get it though.

EXCELLENT ADVICE except for the slam dunk! No guarens but you/she will have a better than average chance.

Daily phone records are a plus also. Get a joint ITF account also. Life insurance, A Will will help also.
