Timeline

My wife of almost 5 Years has a son that will be 18 this Nov. 24. I have filed an I-130 for my stepson to come to the United states to live with us. In the process we recieved an e-mail....................

Please submit evidence that you have been granted custody of this

child. Copies of original court custody documents are acceptable.

In addition to the above, in cases of joint custody or remaining

rights of a non-custodial parent, applicants must also submit a

notarized statement from the non-custodial parent granting

permission for the child to immigrate to the U.S.

No interview will be scheduled until ALL of the information requested has been returned to the National

Visa Center.

I called NVC about this saying that I was the stepfather and that I had no custody papers. They said that the notarized statement from his natural father saying he has permission to immigrate to the U.S. is all I needed but I have a hard time believing what they say. His father didn't have resources to type up a statement, so I typed one up for him to sign and get notarized. When I typed it up it was dated June 29 2009, but they had it notarized on June 26, 2009

I would appeciate any feed back on this thanks

10-14-05 Rec. NOA from Lee’s Summit, Mo. receipt of I-765 & I-485.

10-25-05 Rec. request for additional Information for I-485

11-07-05 sent in additional info for I-485 to Lee’s Summit, Mo.

11-10-05 Customer Service Center Rec. Documents sent 11-07-05

02-23-06 Rec. appointment Letter from Customer Service Center for Bio.

03-15-06 Went to Fed Building in Jackson Ms. for Bio

03-23-05 Rec. EAD cards for Mylah and Kathryn (Mylah’s card was incorrect)

04-06-06 sent in Mylah’s EAD card back in with supporting Documents

A letter Notorized from the father will suffice as far as the NVC is concerned. This was an RFE we received also when I applied for my step sons in 2007.

Why is it that the only one who can stop the crying is the one who started it in the first place?

4/14/10 Email approval for 13 yr Old CR 4/23/10

Oldest son now 21 I-130 filed by LPR dad ( as per NVC CSPA is applying here )
I-130 approved 2/24
Priority date 12/6/2007
4/6/2010 letter from NVC arrives to son dated 3/4/2010
5/4/10 received AOS and DS3032 via email
9/22/10 Interview BOG Passed
10/3/10 POE JFK all went well
11/11/10 GC Received smile.png

[Hello, Why not to try to resubmit the application and the petitioner is your wife. anyway your wife is a green card holder. But you may have to explain to the immigration about the case. Get an infopass and bring all the docs. Its better you and your wife will be present in the immigration office. Its better to do it now while the child is still under 21 y/o. Good luck.

isnt it faster to have the US citizen stepfather file the petition??? it will take years for LPR's petition to be current and there's a chance that the child will aged out...

im guessing you are doing the right thing its just that you have to maybe redo the notarized concent from the biological father. shun from submitting 2 applications for the same recepient. it will cause delays or even denials....

an infopass would be great and a safe step.

------USCIS-- married since March 28, 2005 - I130 filed: july 27, 2007

NOA #1: Aug 6, 2007 NOA #2: Oct. 29, 2009 - APPROVED

--NVC--December 12, 2009 - Case# generated from NVC

December 17, 2009 - hubby received his letter from NVC[/font]

April 13, 2010 - received DS-3032 via email

April 19, 2010 - sent back DS-3032 to NVC thru DHL (did not email a copy)

April 23, 2010 - DS3032 was received per operator and reviewed, received IV and AOS bill thru mail.

April 29, 2010 - paid AOS ($70) fee bill

April 30, 2010 - paid IV fee bill ($400.00 each beneficiary)

May 01, 2010 - AOS shows "PAID" in the system, printed cover sheet.

May 05, 2010 - iv bill shows "PAID"

June 24, 2010 - sent AOS via USPS/certified and prioritized

July 14, 2010 - received RFE. nvc is requesting again for Tax Transcript 2009

Sept 14, 2010 - Mailed RFE documents via usps

Sept 22, 2010 - mailed complete DS-230 via DHL

Oct 14, 2010 - received RFE about beneficiary's police clearances

Nov. 30, 2010 - sent corrected DS-230 with correct years of residency via USPS

Dec. 21, 2010 - CASE COMPLETED!!!

April 28, 2011 - interview date was set to JUNE 28, 2011 @6:30AM

June 15, 2011 - MEDICAL EXAM and will be back fri (6/17/11) for results

June 28, 2011 - Interview

July 12, 2011 - arrived at LAX - and we'll live happily ever after!
