You should follow up with the consulate. Since your petition was approved, the consulate is HIGHLY discouraged from suggesting (because all it can do is suggest) that your petition be reconsidered and denied. The ONLY reason they can do this is if they dicover NEW information about which USCIS was not aware when you filed your petition.

That rule is clearly laid out in the publicly available instructions for consulates when assessing K-1 visas. You can find this on the state department website.

In any letter you write, I suggest you refer to these rules.

BUT, before you send any letter, contact the consulate by phone, if possible. You don't seem to have all of the information. Why did they take your SO's passport? The US government has no right to confiscate valid foreign-issued passports, especially when not being used at a US border (unless there is some agreement with the Phillipines I have never heard of.) Are your sure the visa was denied?

Also, what is this withdrawal she was forced to sign? Did she sign it?

You should follow up, I think you should try to get all of the information straight before you take the further steps of writing to the consulate and your congressperson.

OH YEAH-- are you sure you case is not in admin processing? They should have giving your SO a colored slip at the time letting her know about that. If the case is in admin processing, I think you have to wait 90 days before you make any further inquiries. If it turns out you are in admin processing, there is a whole forum dedicated to it (and waivers).

Thank you for your replies.

No it was not denied, theY did not give her any paper, after the FPU(2nd interview) she was told that they will just call her.

They did not give her passport back but gave back the other proofs (letters, cards emails)

She was forced to signed the withdrawal for our K1 petition, but my fiancé did not sign any papers.

She was questioned and rattled for hours, she said to the IO if they have further q's I'm just outside they can call me but the officer said "no need"

honestly we don't know what to do..should we just wait??

We've been praying hard that everything will be alright and we can be together soon.
