We are confused my fiance and I have done a lot of research and we have found that there are a lot of contradictions. I am from British Columbia Canada and want to move to the US and marry my fiance. I need to leave BC as soon as possible and like everyone else here I want to be with him as soon as possible but I have an added reason why I need to leave. Because of my ex and people he has teemed up with they are making mine and my son's life very difficult here (my ex is not the father of my son). My fiance is worried about us and we want to be with him and have a fresh start and get away from the constant fear and stress of living here. I don't want to do anything illegal but need to know the best way for us to get there and as soon as possible. I welcome any of your opinions and help.

You have 3 options:

1.- File for K-1 fiancee non immigratn visa (in all cases you would add our son to this of coursE). Come to the US when the visa is granted; get married within 90 days; the n adjust stauts. You would interview in Vancouver.

2.- Get married and file a K-3 non imigrant spousal visa. Also interviews in Vancouver and has to do the Adjustment of Status once you are here.

3.- Get married and file for a CR-1 immigrant visa (the best type)

Oh, and you will need permission from the kid's fahter to move him to the ?US --- do you have that? custody arrangements, etc?

Hi L&R,

Bottom line, since you live in BC and your number 1 priority is moving to the U.S. as quickly as possible - file for the K1 visa (K2 for your Son). It costs more (because you have to adjust your status once you arrive in the U.S.) but it is faster because you are able to do your interview in Vancouver and they schedule faster than Montreal (all CR1 visas have to interview in Montreal).

I really appreciate your advice thank you to both of you. If we apply for a CR1 or a k1 at what point would I be allowed to live in the US? My point is I would rather fly to Montreal for the interview if I am in the states than stay here and wait. I thought of applying for a visa that would get me into the US and then doing the CR1 but I've been told that is illegal and I don't want to do anything illegal or to jeaparize things and end up deported back to Canada. Can Canadians still visit the US for up to 6 months without a visa or do we have to have a visitor's visa? Using that would not be to become a citizen and get married it would be to temporarily leave and let things settle here and then come back while the k1 is being applied for and we would be with my God mother in Washington close to where I live not with my fiance who is 3000 miles away. I never new you could only interview in Montreal for the CR1 that is important to know.

I'll let someone else answer about current wait times for the K1 visa interviewing in Vancouver.

For the CR1 you are looking at under a year from start to interview - usually 8-11 months.

You can visit, however, the border people want to know that you are not going to live in the U.S. per se. You must bring strong proof of ties to Canada with you. A letter from your employer, saying when you are returning to work. A return ticket, if flying. A lease for a rental property etc etc - anything that says you are returning to Canada and not going to just jump across the border to live.

There is no reason why you can't apply for whichever visa, then go stay in the U.S. for 6 months - however, you may have a problem crossing the border.

Is the biologial father listed on the child BC? If so then the below applies.

If you choose any route either the embassy or the NVC they will want to have a current document from the father ( yeah sorry ) stating he is allowing the child to immigrate to the US. This may complicate matter immensly for you. Will he allow the child to come?

The wait times for an interview in Vancouver are shorter than MTL. At the most 6-8 weeks and at the shortest possibly 4-6 weeks. I sent back my pkt 3 by fax mid-april and was scheduled for an interview at the end of May. The other difference between VAN and MTL is that with VAN you can fax back pkt 3 and be scheduled an interview almost immediately. You can call DOS to confirm a few days later. They also have a spot on the pkt 3 that has "Preferred Interview Dates" I have never heard of anyone not receiving a date that they requested. Depends on the date of the interview as well. I listed first available Tuesday or Thursday after May 15th or something like that....I would have to check

As per the Vancouver NVC's packet 3 you need to prove "full custody" OR a notarized statement from the father of consent.

If you have full custody by route of a court order then you are well in the clear.

I have sole custody but with a CR1 would my son have derivitive status or would my fiance have to file separate for him like with the IR1? Thank you so much for all the replies we care getting closer to a decision but not quite there yet. If the CR1 is the most economical route and has more benefits than the k3 I'd like to go that route but what is the better way to go compared to a K1?

Canadians Visiting the USA while undergoing the visa process, my free advice:

1) Always tell the TRUTH. never lie to the POE officer

2) Be confident in ur replies

3) keep ur response short and to the point, don't tell ur life story!!

4) look the POE officer in the eye when speaking to them. They are looking for people lieing and have been trained to find them!

5) Pack light! No job resumes with you

6) Bring ties to Canada (letter from employer when ur expected back at work, lease, etc etc)

7) Always be polite, being rude isn't going to get ya anywhere, and could make things worse!!

8) Have a plan in case u do get denied (be polite) It wont harm ur visa application if ur denied,that is if ur polite and didn't lie! Refer to #1

I'm happy to say we made a decision that we are going to get married and do the CR1. Yeah! a decision we based our decision on what we need as far as our situation. We just have to wait for his divorced to be final OMG what a drag but we'll get through it.

Good choice, the CR1 visa, while a bit of a hassle (getting all the paperwork together up front) - is much easier in general as you can work right away if you want etc etc.
