Help..!!!..my wife went to her interview at the embassy in manila in may. Her intervew went well but St Lukes did not send over the medical results in time for her interview. She was told they would contact her when they receive the results. After weeks of waiting I called the embassy as was told they had send a her a letter…(which we just received) stating that she had to come back for and interview on July 7th.

On the letter was a line checked off saying ….$545.00 Application for Waiver on Grounds of inadmissibility….I called the embassy again to find out what this meant. On here medical she stated that in 2006 (june?) she smoked marijuana…..but she still needed to come to the embassy and pay the money.

Sadly, at this stage the embassy will not discriminate between not knowing what she was trying and knowingly smoking marijuana. You will have to file the waiver at this point.

Hello,

the Mrs just got back from the embassy she was given a waiver for 212h, she spoke with the consular at the embassy and paid her $545 and got her paper work to bring home....now its time to get the lawyers....hopefully this will be over by november....thats what i am praying for.

its been a very long time since i have been on this forum. i will give and update.

Last Sept I submitted the waiver and all supporting evidence to the Embassy. The waiver Package first went to the "Visa Unit" at the embassy where they were charged with making sure the I-601 was filled out properly. The Visa Unit contacted my wife 4 weeks later asking us to resubmit and "updated" I-601 application ( a more current form), which we did. In December the Visa Unit sent another letter asking for my wife to fill out the "I-601 Questionnaire", which we filled out and sent back to the Visa Unit. The Visa Unit was finally satisfied and forward the I-601 waiver package to the DHS on January 21,2010.

I called every week from January. On April 21, I was informed by the DHS that application was sent back to the Visa Unit (i took this as a good sign!!!!). DHS at the time could not tell me whether the waiver was approved or denied. I called the Visa Unit and was told they were reviewing my Case ( but they also could not tell me if the waiver was approved or denied). Both times that I called the DHS and the Visa Unit, I got the receptionist who could not give me much information. I emailed the DHS on Tuesday for a clearer answer. They email me back the GOOD news that my wife did not need a waiver and her file was sent back to the Visa Unit for processing.

this is the wording of the email i got tuesday.

"The request for visa waiver was returned to the Immigrant Visa Section on 16APR10. Your wife is admissible and therefore does not need a visa waiver. Conduct your follow-up with the Immigrant Visa Section. Their web link is http://manila.usembassy.gov/wwwh3230.html. The link has a drop down system to send inquiries to that section."

Im still surprised and dumbfounded but happy nonetheless. In July the Consular Officer informed my wife she need to file a waiver and pay the fee,( i have all the paperwork she was given) all of which we did. With the help of a lawyer we submitted the I-601 in Sept of 09. I guess DHS felt that perhaps our case did not need to go DHS and sent it back to Immigrant Visa Section; which is where it is today.

I paid for a lawyer and the I-601 fee, but im still happy with the outcome even though i am out of lots of money. I have some peace of mind now. Hopefully my wife will be here soon; and the next part of this long process will continue.

UPDATE: today my wife got the Official letter from the DHS in Manila...stating my wife is addmissible (she did not need a waiver in the first place)..she now has another interview with the embassy on May 24...im assuming at that time she will be told what she needs to get her visa .....I'm happy the tough part is over...now the our visa saga continues...

Good luck! I hope everything will turn out well this time. I know it's frustrating, it took more than a year since application before I had my interview. Just be positive and keep on praying.

UPDATE:..My wife went to the embassy for her May 24, interview. The counsular officer informed her that she would need to renew her NBI clearance and take a new Medical. She was also told to fill out the form for Air21 ( the local courier that the embassy uses to send the passport with the visa). My wife will have her medical in mid June. We are hoping to have her visa in late june or early july. We are hoping we are near the end of this long journey. I will not consider this over until we have visa in hand......

Just a question .... did USCIS advise how she is supposed to fill out the medical form in regards to the marijuana question?

It would be horrible if you guys end up in another loop with this!!

It is a good sign that she paid Air21. That means her visa is approved, pending her NBI clearance and medical exam.
