Hello..just wanna ask something here,i hope someone can help me and to my husband!!!

i have a 2 step daughters and i love them so much they are so nice,smart and fun to be with..My husband and their mother was never been married but the child custody is in my husband but the court said the mother has the right to get the kidz during vacation anytime she likes and also she must give a child support to the 2 girls monthly which is she never did...Now my question is,does the kidz also has the right to refuse to their mother not to go with her?the kidz dont like to stay with their mother,they always crying in every vacation because they know that their mother will come and get them with the cops accompanied her..Just last june 12,the kidz end of school days we came home from the mall and their mother and the cops waiting us and the kidz already told to their mom and to the cops that they wont go with her,but the cops said they'll gonna arrest my husband if the kidz wont go with their mother because according to the cops the kidz has no right to refuse because they are under age..What is the best things and legally to do with it?need some advice..thank you..

at that age, the courts will allow them to disassociate with the mom. seek the advice of a family lawyer..........

Were thinking of that idea,i feel pity for the kidz.They keep on calling and texting us that their mother always drunk and they dont want to go their mom's house the next next year vacation..

I would pay them to go with their mother. The fact that they obviously don't want to go with her mixed with the deadly combinations of them being teenaged and female will ensure that the vacation will be absolutely miserable. For me that would be enough, but then you also get the benifit that she'll never insist on something like that again.

Well,the kidz might like to go with their mom if she only does her duty but she did not!!!She didnt even treat the kidz for a shopping,not even call them except calling them that shes on her way for pick them up,cant even send a b-day cards,x-mas cards!!!

This is a family court issue - the court can decide if the children should not have visitation. This is not likely to happen unless there is proof the children are in some sort of danger (or some sort of harm).

Yes if there is a court order to pay child support and she does not then is a legal remedy but if there is a court order for visitation and that is denied the one denying it is in the wrong. I hated to go to my mothers but had to do so.

Yes it seems its time to talk to a lawyer, child support will probably be handled on its own.

As for visitation have the girls write a journal of their time with their mother, date it and keep it. I was told by my lawyer to keep one any time my ex had contacted me or the kids. Not sure how much weight they are given but they are more accurate then trying to remember things 2-3 weeks or months later. It may help.

With their mother showing up at the house with police she is aware that the girls don't want to go with her, maybe that can be used against her in court also. I would think it would be pretty scarry for them being told go or we will arrest your dad.

Anyways its deffinitly time to get a lawyer.
