Here is the situation. She is married and have 2 kids and they files tax jointley with her husbond her income above the poverty line The question I have what she needs to do? Dose her husbond need to sign the form or she is the only one needs to do that?. Also, her husband have green card only but she is a citizen how that works? What dose she need to provide as an evidence of her income? and her husbond if he require to provides any?

Also, in the RElation to sopnsor... what she should put there?

in the item 8- the following person are dependent ... dose she have to list her 2 kids and husbond?

in Item 10. What she should write?

item 11 what should she list type of support?

Thanks for your help

If your friend sponsored her husband for an immigrant visa she will have to include him in the household count.

Only one person's income can be used for the I-134 affidavit. She cannot combine her income with her husband. For the I-864 affidavit of support used at AOS incomes can be combined.

Relationship to person being sponsored is "friend"

If she sponsored her husband (or anyone else) she would list that person or persons there.

See the Example Forms here on VJ for guidance on how to complete any form. Example I-134 The Example Forms link is at the top of every page.

Realtion to sponsor is "friend"

ONLY her income counts. She needs to attach documentation of HER income. She does not have to count her husband IF he also has income. She does have to count her children. Her family size will be FOUR, her, your fiance and two children.

She needs to provide an I-134, same as you and supporting documents, same as you.

Answer to question 11 is "NA K-1 visa for permanent residency"

Her husband had his green card from different marriage.

She would submit her joint return but attach HER w-2s showing HER protion of the total income. She should also attach recent check stubs, an employer letter is nice and a bank letter is great. Since your fiancee does no tknow this person and will likely not be able to answer any questions about her, the more documentation you provide the better.

If her income is sufficient, and well documented, she can leave the asset information blank.

Thanks Gary
