I-134 compliance without a job?

Timeline

I am currently unemployed, and visiting in China with my fiancee', awaiting approval of her I-129F. In anticipation of completing the I-134, I wonder if existing assets and bank balance will suffice in lieu of a paycheck? Anyone with information or experience here?

Do your savings/assets equal 3x $18,212?

From what I have seen, China is very hard on interviews - I don't know if savings/assets will work.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

Yes. Assets need to be 3x times the needed income level. If your income is -0- you need about $60,000 in assets to make up for it. Assets must be able to be converted to cash within one year and cause a hardship to the family. Also, only the net value of assets count. Retirment funds can be used BUT the amount will be reduced by any penalties for early withdrawl. You need to provide statements and policies or early withdrawl, appraisals for real estate (tax assessments will work) and mortgage statements showing current amount owed. It is basically a can of worms that is not desireable to open, but you can do it. You can also use a co-sponsor at most consulates.

(I'm going for the IR-1 and blowing off the K-3. Even if it takes an extra couple months, it's worth it to not have to deal with USCIS again)

Note:

Please fill out I-130, wait 6 months for approval, then 3 more months for an interview. (Unless of course we've bombed your country into the stone age, then you qualify for expedited processing.)

I am still in China with Hui. Her interview is in 3 weeks, and I need clarity. My cash assets verified by bank letter exceed $75,000, personal property that can be liquidated without hardship exceeds 3x the 125% poverty level, and equity in real estate is documented over $175,000. From all I have read, this should suffice. Am I OK?

YUP - you will be OK.

BUT.

Whatever documents you get in to PROVE this, make sure they are notarized or AUDITED by a CPA.
