My girlfriend is from Mexico and I met during her J1 visa and now we would like to get married. How long does she have to spend outside of the U:S in Mexico before we can get married. Is the spousal visa or the fiancee visa possible-difficult after a J1 visa?

thanks so much for any help!!!

2 years only if it is subject to the home residency requirement... Not all J-1 visas are

fiancee or spousal visas are possible if the applicant is eligible... if the applicant is not eligible then it would be difficult

Applying for K-1 or K-3 shouldn't present any difficulties in direct relation to the beneficiary having had a J-1 (unless they are subject to the home residency rule - ask her to look at the visa in her passport, it will say in capitals along the bottom whether it applies to her).

I had a J-1 visa to work as an au pair in the US and it hasn't thrown up any glitches so far - but I know that other former au pairs with J-1's have had their K1 approved no problem.
