Hello everybody, im just wonderin if i can travel inside United States, im married and dont apply for my green card yet, my visa is already expired, anybody can help me, what are documents i need to bring with me? Thanks!

The fact that you are married is not gonna change anything until you apply for AOS. I've flown inside the U.S. 5 times since I came here on F-1 visa, and they never look at your visa at the airport-they always look at your biographical page. My visa expired in January but my I-94 is valid for duration of status, so visa in the passport is not always the most important document to have. I think you should be fine evenwith expired visa. Good luck.

2-year green card application:

07/29/2009- Mailed I-130, I-485, I-693, I-864, I-864A, G-325A, I-765 via USPS.

08/02/2009- Package delivered to Chicago.

08/06/2009- Checks cashed.

08/10/2009- Received NOA's for I-485, I-130, I-765 (issued August 6th).

08/19/2009- Recieved Biometrics Appointment notice (bio apt 9/12 at 9am).

08/21/2009- Recieved RFE for I-485 (issued August 17th).

08/22/2009- Responded to RFE.

09/01/2009- Case processing resumed (RFE recieved on 8/27/2009).

09/01/2009- Walk-in biometrics at 1:00pm, in and out in 15mins.

09/09/2009- Recieved e-mail: EAD card production ordered on 09/08/2009.

09/14/2009- Recieved another e-mail: EAD card production ordered (AGAIN!) on 09/11/2009.

09/16/2009- EAD recieved in the mail.

09/21/2009- Applied for a SSN.

09/30/2009- Recieved SSC.

10/14/2009- Received interview notice (Interview on 11/16 at 9:35am)

11/16/2009- Interview,APPROVED and CARD production ordered e-mail!Yay!

11/19/2009- Welcome Notice Recieved and Card production ordered e-mail again!

11/27/2009- Received green card in the mail!

Removal of Conditions:

09/09/2011- Sent the package via Priority mail, with delivery confirmation.

09/12/2011- Package delivered.

09/13/2011- Check cashed.

09/14/2011- NOA issued and received on 09/17/2011.

09/15/2011- Biometrics appointment issued for 10/05

11/21/2011- Card production ordered.

How long have u been married and how long ur visa has expired? I think you can as long as not outside the US. just bring ur documentation just in case like ur marriage certificate, passport.

Your K-1 visa expired as soon as you entered the US POE. What you should be going by is your I-94. It is good for 90 days.

If you are past 90 days, you are currently "out of status" - subject to ICE proceedings, regardless of your marriage.

Depending on where you are travelling in the US, you could be intercepted by ICE, for example, Texas has a track record of traffic checkpoints for illegals.

There are posts here of people in a similar situation and they had issues.

In one case, they had their passports, marriage certificate, yet ICE didn't care.

Only the NOA from the AOS submission will put your status to "applicant to adjust status" - which makes you safer than "out of status".

I always recommend, get the AOS prior to the 90 days expiring - but everyone has their own take on this.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

My point was u can travel with an expired visa within the US BUT you should have proof of AOS,,and u mentioned you have'nt filed for AOS yet.I hope you have to be careful of that.

Just want to add if you live or are traveling to border areas make sure to carry proof of AOS. If your 194 has expired and you haven't applied yet stay very far away from the border...you don't want to get caught in a checkpoint as they will try and deport you. (Obviously the Mexican Border not the Canadian).

Bobby & lancer1655 are absolutely correct. Do not go anywhere near where an immigration checkpoint could be! I can't believe the responses along the lines of "I'm not sure, but you should be OK" -- if you're not sure, don't post anything!

:dance: just got back from vacation, and i want to update my concern here,

so far so good, i dont have any problem with the Four airports, since i dont apply for my AOS yet, i just brought with me my marriage license and my driver license under my single name, and of course my passport and my SSN under my marriage name, ( got my ticket under my married name)

Phoenix airport, i showed my driver license and and my SSN, and still i showed my marriage license (original)

Detroit airport, i showed my driver license and SSN

Boston airport i showed just my driver license and SSN

and Ohio airport i just showed my driver license

ahhh, so glad our vacation is over and we have so fun, came back home safe and sound!

for those who had concerns like me, here you go, make sure you bring your documents, it will helps!

PS

my driver license is expired! (student permit using my single name)

visa is expired

my tiket is under my marriage name

passport is valid (not expired)

SSN under my married name

marriage certificate (original) but i brought some copies too)

so complicated i know, but i made it through with out any hassle or trouble!

yes i passed 4 domestic airport, without any trouble,they dont even bother to ask my passport, they just look at my driver license and SSN and they let me get in.

It's means that you can travel on air even you visa is expired,just make sure bring those supporting documents in case they will ask for it.

So, because one person got away with it, this makes it safe for all others to do the same? How irresponsible is that advice? Oh -- and create your VJ timeline, please.
