K1 Expedite Request Approved

Timeline
Is this something new just started or what???

What does it cost???

I filled K1 August 13th and still waiting for packet 4

45 days since pack 3 sent back.

Vermont Service Center

May 9, 2009 - NOA1

June 23, 2009 - Expedite Request Approved

July 1, 2009 - I-129F approved!! NOA2 sent ---------- less than 60 days total

I waited 227 days for my NOA2

K-1s are not eligible for expedite except military personnel about to be deployed to combat areas. It costs a minimum 4 year commitment to the military and service in a combat area, I think combat deployments are running 13 months now, maybe more.

Timeline

Basically when I refiled my attorney said give it 30 days as she had requested an expedite of our petition in writing. Nothing happened. She then suggested asking my congressman to request in my place. He did and was kind of ignored. They replied that there was no proof of the previous submittals (there was in the file) and they cannot do anything regarding errors, they must go by the NOA1 date and you must wait your turn. So then the attorney said she would request it herself. So she sent an email to USCIS and my petition was approved the following day.

Wrong.

There are Vj members who have received expedites for medical reasons as well as USCIS error.

Doesn't necessarily have to be related to a deployment, but usually is. Also the standard BOG (boots on the ground) is 12 months now. As for the 4 year commitment I don't believe that's relevant... USCIS looks at the merits of the case (they wouldn't even know what the service member's contractual obligation or time in service is).

I wish they would honor the criteria for expedite but they do not! I had an USCIS error which delayed my case by 7 months because of them misplacing my paperwork.

It seems that the only people that do get it are the millitary people and I think they should, we need to give them all the curtesy and respect for their sacrifice for this country.

I wish they would be fair when they mess up but it is not a perfect world after all!

Timeline:

04/09/09 : I-129F Sent to Vermont

04/10/09 : I-129F Received by USCIS

04/14/09 : NOA1

08/19/09 : NOA2

08/24/09 : NVC Received

08/25/09 : NVC Left

08/27/09 : Consulate received

08/28/09 : Packet 3

08/31/09 : Packet 3 sent

09/16/09 : Interview - Approved

09/21/09 : Trip to Dallas

I'm still not seeing the direct link, to your expedite being approved because of USCIS error...did they specifically state they're approving your expedite becuase they ef-ed up, otherwise it could just be a coincidence that the petition was approved the day after the attorney e-mails USCIS.

True perhaps it wasn't an official expedite because my attorney never got a reply but it certainly was expedited and not a coincidence. At that time petitions were taking a minimum of 120-160 days to get approved at CSC where as that third filing was approved in 70 something days. I received two touches, one the day of the email and the following day. It was obvious that after reading the attorney's email they thru my file on top of someone's desk.

Regarding the "who's file" I was refering to my file. I had submitted my old shipping receipts and well as a rejection notice due to a misfile.

I'll outline the errors below:

I submitted my first file from the UK to the Nebraska Service Center in early September. Now at the time I wasn't a member here and even though I had read somewhere that the service centers were changing in August, I could only trust the USCIS website which showed Nebraska as the correct place to send it. (They didn't update the website for over 3 months) Due to this misinformation and the answers I was getting from USCIS I decided to wait 90 days as they instructed. USCIS was saying that they were forwarding petitions but it was a slow process that could take a few months. At 90 days I put service request in that came back negative. I then made an INFOPASS appointment the following day where I was instructed to wait an additional 45 days. A few days later my parents called saying that the file had finally shown up on their door.

I thought I had things covered because A. I put my parents saint louis address on the package. B. I placed a forwarding address to my fiancees parents house with Royal Mail. Unfortunately I was later told that Royal Mail won't forward government mail. So the package sat with Royal Mail for a month then was sent back to Nebraska. This time they noticed my parents address and sent it there.

So I then repacked everything and sent it to CSC. The mail guy there opened it scribbled I485 on my cover letter and a few other things and sent it to chicago. Now I had put at the top of my letter in big bold that it was a 129F Petition for K1 Fiancee Visa and had sent it to the correct PO Box. So now it flys off to Chicago where instead of sending it back to CSC (which by the way why have they decided to start forwarding mail now when they could have done it in 07 anyway...back on track) they reject it and send it to me.

So next I was really wanting an expedite because I had been waiting for 5 months and a file wasn't even with USCIS because of the above. AS I mentioned above the petitions at that time were taking ages because CSC was grinding to a stop they were processing petitions between 4 and 6 months where VSC was doing it in under 2.

So in conclusion, I agree that it was what I like to call a "soft" expedite where an employee at CSC probably saw the email felt compassion and made sure it was processed that day. Sure for someone on that outside you could be skeptical and say it was a "coincidence" but I think its somewhat naive. CSC was a machine that had practically grinded to hault when I was approved.
