Perhaps a military petition?

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

WARNING: Phrases in this post may sound meaner than they were intended to be. Read the Adjudicator's Field Manual from USCIS

Yeah, expedites are only available to those in the military, if I'm understanding correctly.

That option has been there as long as I have been around here (since 2005), it's nothing new. But unless you qualify (and unless you are an ACTIVE duty military person, then you don't), then you can't use the option.

Here is a link to reasons for an expedite

http://www.uscis.gov/portal/site/uscis/men...0000ecd190aRCRD

There are other reasons, other than military.

All expedite requests are reviewed on a case-by-case basis, and are granted at the discretion of the Director. The criteria are as follows:

•Severe financial loss to company or individual

•Extreme emergent situation

•Humanitarian situation

•Nonprofit status of requesting organization in furtherance of the cultural and social interests of the United States

•Department of Defense of National Interest Situation (Note: Request must come from official United States Government entity and state that delay will be detrimental to our Government)

•USCIS error

•Compelling interest of USCIS

I can explain it to you. But I can't understand it for you.

cdneh: Thanks for the info! Good to know!

I'd just like to go ahead and state here for all that are reading this and will read this in the future though, that they almost NEVER grant these expedites. Just FYI.

Military expedite is probably the most commonly approved, but the post before mine has the full list.

No they don't, although they are there you hardly ever see anything other than the military one approved.

Hey Lancer, can you give us more details? I'm not even applying for a K-1 but if you give us more details than maybe it will help someone else later who searches and finds this topic.

Ya, please more info. I've never seen anyone get expedited for USCIS error before. Interesting to hear what they messed up and how you got them to admit their mistake.

To the OP, your wait time is SIGNIFICANTLY over the average unless there were other issues that I'm not seeing right now. No real reason for it unfortunately. Some people just get unlucky or there was other stuff going on.

K-1s are not eligible for expedite except military personnel about to be deployed to combat areas. It costs a minimum 4 year commitment to the military and service in a combat area, I think combat deployments are running 13 months now, maybe more.

Wrong.

There are Vj members who have received expedites for medical reasons as well as USCIS error.

Bit confused - you received an expedite approval but don't know where it came from? You did nothing to initiate this expedite?

Edit: N/M I see the post below...

I think you are referring to my case.. we applied for an expedite because my fiance will be deploying... we also had to wait for them to decide whether they will approve it or not and had to send a letter from his commander as a proof of the deployment.. my fiance will be deploying in a combat area.. :crying:
