Hello, all.

I am filing for AOS from B2 through marriage.

I've done a lot of research online on uscis, visa journey, and other online sources. I would like to, and I'm sure it's better to, file for AOS while my B2 is valid as much as possible, but I see that some supporting documents might not be prepared soon enough. I will do my best, but some things are out of my control.

If anyone could advise me which forms and supporting documents must be submitted first, and which can be submitted later, that would be very helpful.

1. I-130

---Proof of US citizenship of a spouse

---Marriage certificate

---Proof of divorce

---G-325 (Biometric information)

2. I-485

---Birth certificate

---Copy of passport with non-immigrant visa

---Photos

---Police clearance (I need it right?)

---Medical examination, I-693

---Affidavit of support

3. I-765

---Copy of I-94, front and back

---Copy of previous EAD card

---Photos

4. I-131

---ID with name, date of birth, and my photo

---Copy of AOS receipt

I believe #3 and #4 can be submitted later. My concern especially is my birth certificate and police clearance for I-485. Since I need to get it from my country, it could take time, at most, a few months.

If any supporting documents could take time to be ready, do you think I should wait even though my B2 will expire by the time I can collect all the documents to file for AOS?

Or is it better to send what I can prepare before my B2 expires, and send rest of the necessary supporting documents later?

If I'm missing any necessary documents above, please let me know as well.

I dont think you need police clearance. I Adjusted status from B2 but i did not submit a police clearance. Read again the instructions regarding who needs Police clearances. If you have a photocopy of your birth certificate, that would be enough for now. If you really need to wait for other documents, submit the I-130 first (just make sure u have all required docs) and then when all other documents are complete submit the other forms together with the Receipt Notice or Approval notice for I-130. Ofcourse, its still all up to you. This is just my opinion.

If your in the US you do not need police checks.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

Thanks for quick responses. I also just found out I don't need police clearance after more research.

Hopefully I can prepare everything on time.
