Okay here's my idea. My fiance lives in Japan. She as been to the states a few other times and she can get a tourist visa fairly quick. Now here's my question. If she came here on the tourist visa to visit me is there anyway for her to have her interview here instead of doing it in Tokyo? So instead of going back and forth they'd just send the packet to me and we could get it done here in the States before her tourist visa expired. If anyone has any info on that please let me know.

Summer of '04 - Started Talking to Leila on Yahoo Messenger

3/23/06 - Went to Cebu, Philippines to meet Leila & see her graduate. Also proposed during my trip.

4/30/06 - Leila left the Philippines to go back with her dad in Tokyo, Japan.

5/01/06 - Sent I-129F to CSC

5/09/06 - NOA1

7/29/06 - In Tokyo with my beautiful fiance!!

7/31/06 - NOA2 Approved while in Tokyo!!!!

8/06/06 - Just got home from Tokyo... Goodbyes are so hard :(

8/07/06 - NVC Recieves case

8/11/06 - NVC Sends case to Tokyo

8/17/06 - Embassy in Tokyo sends Packet 3 to Leila but she was in Atami

8/22/06 - Leila calls embassy and they tell her what she needs to mail in

8/23/06 - Send Packet 3

11/3/06 - Recieved Packet 4 (took longer than usual because my fiance is not a Japanese citizen so her

paperwork had to be verified with Korea... very irritating)

11/7/06 - Medical Exam

11/20/06 - Interview!!!

1/12/07 - Arrival in US

2/14/07 - Wedding

HI! If you have filed for the K-1 visa already you can't transfer the papers to the United States as she supposed to be interviewed in her home country for to obtain a K-1 visa.

So you can either cancel the fiancee visa petition right now nor wait when her petition will be approved and she will be called for an interwiev to the American Embassy in Japan and obtains a K-1 visa.

You can also adjust her status different way as well.You can marry her when she arrives to the U.S. on the tourist visa.Dont forget to get married before her tourist visa expires.So , after you get married you can apply for her adjustment of status papers the same way as everybody else does with all sorts of visa types. The tourist visa will be treated the same way as all other sorts of visas and she can be adjusted here without no problem.

Though i am not a lawyer ,but knowing the basic rules i can defenetly tell you that you wont have any problems by marrying with the tourist visa and especially when its very easy for her to obtain it.

Still,you should contact an immigration attorney in your area.

What you are suggesting MIGHT HAVE BEEN possible had you not filed for the K1.... Now the USCIS knows there is an intent to marry.

She will need to return and wait for her interview.

She will need to return and wait for her interview.

Thanks for the replys. I know its not a good idea for her to come here on a tourist visa and then get married. I just didn't see the difference between her having an interview here or there. But... I don't make the rules. Hahaha... I'm going to visit her again in Tokyo on the 29th of this month. I should just go and marry her. Aww... but then I'd need to start all over again with another process. Thats it!! I'm moving to Japan!

HI! Yeah i also didnt think about the possible problem as you have already filed for the K-1 visa ,thats true the American Embassy might not issue a tourist visa for her again as they might think about the intent to marry on the tourist visa ,but who knows they might issue the tourist visa its difficult to say.

Though if i were you i would wait for the K-1 visa petition approval and etc... Bring her over on a K-1 visa.

The process doesent take too long time actually .It takes about 6 month maximum before she will be called for an interview an the visa is going to be delivered within 3 days after the interview.

Though,if you still decide to bring her over on the tourist visa and she will get lucky to obtain it while

the K-1 visa petition is in process ,you will be able to get marry her on the tourist visa and obtain her adjustment of status papers without no problem at all. You can read my previous post concerning that matter.

Also if she gets her Tourist Visa denied, she might have to wait at least a year to obtain any other kind of Visa...so be careful.

Hi! Best wishes to you and Good luck with that too! But ,remember if you marry her in Japan ,you will not be able to bring her over to the U.S with the tourist visa and on the K-1 visa petition as well as the K-1 gonna be denied. So ,basically after you get married her in Japan you will have to file for a totally new process again and its gonna be an obtaining a Spouse visa process and the visa type is gonna be called as a K-2 or K-3 then i dont remember excactly..So ,thats gonna be a beginning of the total new process.

Though,i dont know when excactly you have filed for the K-1 visa ,but it will take about 6 month maximum for her to obtain it. So if you dont marry her while in Japan you will be able to bring her over to the U.S much faster on the K-1 visa and marry her in the U.S. Also, the dissadvantage iof by marrying in the Foreign country is that the Marriage Certificate which is gonna be issued in the foreign country thus Japan is gonna be written on the language of the country where the people were married and you will have to translate it intoEnglish later with the notary verification when filing for the Adjust of Status in the U.S.

Ok,its just an advise.

But do what your heart tells you to do!

I want to thank everyone for the advice. Too bad its not what I wanted to here... LOL! I'm just trying to find the quickest way to be with my fiance. I'm sure everyone is feeling the same way. Thank God for Skype!! We talk and see eachother just about everyday but its not the same as being there with the person you love. I want to wish everyone luck and much happiness. Wait... I have an other idea. Mabye the CSC will let us go and help process applications on our spare time to help speed up the process. Good idea, huh?? I think we should start calling and emailing them about it. Or... just wait *sigh*

Just for a week :( I met her mother and her brothers in the philippines and now her dad wants to meet me. So, he offered to fly me out to Tokyo.

What a hardship :P

Only one week? Barely enough time to adjust to the time difference.

Well, you know as well as I that the likelihood of your case progressing that fast is unrealistic, but never give up hope!!
