The Social Security office is a nightmare here. God I hope this has not screwed up our AOS application.

They first told us my wife could not get a social security number, then relented but screwed up her application for a social security number twice in front of us, and then filed it in the wrong place.

They called today and said they had just found it, and they could no longer process it because of their own damned mistake. They said we would have to get an extension of the I-94 or else we can't get a social security number for her.

Well they don't know how to get an I-94 extension and we have the proof we were in there a month before the I-94 expired making our application, so this is an outrage to make us contend with this.

What I am most worried about is that we are just today filing the AOS, and I have no idea if the lack of a social security number is going to prevent the AOS from going through.

First question - can she get an AOS approval without the social security number? We could then go back with the green card and ask for a social ecurity number. Second, is there a way to extend the I-94 under the circumstance? Is there some other thing we should do?

Please help.

You can file without the SS. I'm not sure if you can get an SS now that they have made the mistake. No one can extend the i 94. However, you can try to get a SS again when the EAD comes through in 60-90 days.

Do you have the copy of the paper they gave you when you filed the application for SS#, the receipt. Did you happen to get the SS# from them.

I don't know if it is like INDIANA but they gave us a receipt, and said we could come back next day to get the number and believe me we did. 7 days later she got SS card in mail.

If you have receipt, it has all the info including date you applied go back and talk to a supervisor or manager and don't relent until they fix their mistake.

Appreciate the comments, thanks - I wrote moments after finishing this outrageous phone call from the Social Security office.

It was baffling and distressful because of course the social security employee does not want to just tell me the straight truth in plain english:

"Hi - We just found your application because we lost it, and now you cannot have a social security number because the I-94 deadline has passed"

She also had no idea what she was talking about in sending us to the Department of Homeland Security to ask for an extension on the I-94. Talk about gross incompetence.

We are also suspicious that she still did not enter the name correctly. I am curious from others here what their paperwork said.

When they handed us the letter confirming our application for the third time (first two had mistakes), it was addressed to her maiden name instead of her married name. We asked why it was in her maiden name if the whole point was to get the social security number in her new married name. She claimed it was OK, but she screwed so many things up I have little faith in what she told us.

Did you receive your confirmation of your application in your maiden name or your new married name? We were insistant that we wanted the social security card to read as her married name. It is what we understand to be the first and most important step in officially changing her name.

We just filed for the SSN yesterday... we didn't get around to filing until after the I-94 expired & had to wait for the EAD (which took between 2-3 months from the time we filed for AOS). If I were you I would go back to the social security office, ask for a supervisor & bring the letter they gave you when you first applied (we got a letter, I assume you did as well).

Worst case is you have to wait for the EAD before you apply for the SSN again... it's inconvenient not to have an SSN but not a show stopper. Good luck!

Geez the last post of mine I was trying to edit and the time expired before the edit got done completely. Try again:

thepizzadude - we got a receipt and they said we would get the card in about two weeks. We waited and nothing came, so went in again to talk to them. They were rude to us and said that the paperwork they handed us said it might be up to three months. Well, it did but we were verbally instructed to come in if it did not come to us in a few weeks. So after doing exactly what we were told, they pretended we were somehow out of line for coming in again. Today too the lady started off politely enough while she was busy being coy and asking me to do an impossible thing (extend I-94) to fix their own mistake. But then she got pretty defensive and kept interrupting me... sheesh.

nowhereman - thanks. I was pretty upset and confused. This lady just chirped on about how my wife was out of status and how I needed permission to stay longer.

Obviously totally incompetent with social security - her own job - so completely clueless on immigration.

Just awful.

Yes, you can get AOS without SSN.

The SS office is full of untrained clerks who make up laws rather than ask questions. I will repeat again...K-1s are eligible for SSN immediately on arrival. Go the NEXT DAY after arrivall and apply for the number. If they give you ANY trouble ask for a supervisor, they are untrained and have no clue what they are telling you. They will not issue an SSN within 14 days of I-94 expiration. DO NOT WAIT. Get the SSN before you unpack the bags.

You do not need it for AOS, but it comes in handy for lots of other things

Here's a clue. Go to SS the DAY AFTER your fiancee arrives. Go to the SS office the DAY AFTER you apply and ask for the SSN, they generate the number and update the sytem overnight. The can tell you your SSN the day after you apply. If they don't you have problems. Correct them immediately.

I know, it is a pain, but unfortunately necessatry. Maybe Obama will train SS clerks after he fixes the auto industry

Here's a clue. Go to SS the DAY AFTER your fiancee arrives. Go to the SS office the DAY AFTER you apply and ask for the SSN, they generate the number and update the sytem overnight. The can tell you your SSN the day after you apply. If they don't you have problems. Correct them immediately.

Going to the social security office reminded me of going to the Department of Motor Vehicles... lots of people & slow moving. The rep I dealt with did have a good attitude at least (DMV reps often don't).

On the other hand, you should also not file for a SSN too soon either.

You should wait 2 weeks after you arrived in the US before applying for a SSN. If you go too soon your

record of arrival will not be in the SAVE-ASVI system yet, and it will require manual verification from the

USCIS. As this will add weeks to the period it takes to process the SSN, it is advisable to attempt to wait the two weeks to be safe.

:thumbs: There are plenty of people who have trouble when they go TOO soon, it appears to add a whole layer of administrative nightmare for one. We waited 10 days and it took 1 more week to get the card.

I'm feeling you on this one, I'm having the biggest trouble of getting a number myself. I cam here on January 17th and having read the guide I waited until Feb to go apply for a number. We were already married at that point in time, so I tried to get it in my married name, taking the marriage certificate and everything. I got a letter saying I applied for the number and they have to verify my data with USCIS and will let me know in 6-8 weeks (all that after I had a 30-min discussion with the lady if K1's are eligible to have a SSN - go figure). So I waited 6 weeks, but at that point in time my K1-status was about to expire, so I waited for my EAD to come. 10 days after I received my EAD in the mail, on June 5th I went to another office (the first one was obviously incompetent) and told the lady my story. She was a lot more helpful, but also had to tell me that I'll have to wait another 6 weeks because they have to verify me/my data with USCIS. Now I have my Greencard coming within the next weeks (card production is ordered), so I called the office yesterday and asked how my application status is, and I was told that everything STILL has to be verified. I asked her if I can speed the process up if I show my GC and of course, she didn't know. She told me to wait the last 2 weeks and then come back to the office. :angry:

I'm actually considering contacting some officials if they tell me to wait again in 2 weeks.
