question regarding our marriage certificate

if i m petitioner filing i-130 for my parents - do i need to submit our marriage certificate (i married a US citizen and will be becoming citizen shortly - and its my parents in india that are in question)

also when submitting i-130 i am including app, 355 fee, copy of my citizenship cert, copy of my birth cert showing both parents, copy of parents marriage cert - am i missing anything here?

What sort of visa do you think your parents are eligible for? As a permanent resident, you can only sponsor your spouse or children. You can't sponsor your parents. Your US citizen spouse also cannot sponsor them because they aren't her biological parents (I presume).

Once you become a US citizen you will be able to sponsor your parents as immediate relatives (IR). Here is the process for a US citizen to sponsor their parents:

i am USC - and applying for both my parents fm overseas - please advise on 2 questions above

You said in your previous post that you were not a USC, but that you would be getting your citizenship soon. :whistle:

No, you don't need to provide your marriage certificate. Whether or not you're married, or to whom you're married, has no bearing on sponsoring your parents.

To petition for your mother you need:

1. Form I-130

2. Copy of you birth certificate

3. If your name or your mother's name on the birth certificate is now different, provide proof of legal name change

4. Copy of your certificate of naturalization or US passport (proof of citizenship)

To petition for your father you need:

1. Same documentation you need for your mother.

2. A copy of your parent's marriage certificate.

3. If parents are divorced, a copy of the divorce decree.

The preceding presumes your parents were married when you were born, and that you were not subsequently adopted by somebody else. Filing fee for the I-130 is currently $355. Your parents will notified by the consulate of any additional documents required once the petition is approved.

you need your marriage certificate too together with your other docs to petition your parents because you already changed your last name, if you are using your husband's last name. "any docs that pertains discrepancy between your name on your birth cert and your current name" hope im right.

I don't know if the OP is male or female, but I think it's safe to assume from what has been posted that the OP obtained, or is going to obtain, their US citizenship AFTER they were married, so their proof of citizenship would have their current name on it. The OP's marriage certificate would not be required.
