Looks like they are making this a little easier. Wish I could use it but it seems we will have to use the I-134 at this stage anyway.

Ok, now how do we determine who files a I-134 or a I-864 form? I found out today that the packet #3 was sent out from the U.S. Consulate in Guangzhou on June 30, 2006 to my fiancee.

Seeing that we're already on the subject of the I-134 and the I-864 forms does my fiancee send one of these forms in with packet #3 or does she take the I-134 and/or the I-864 form with her to the interview?

I'm thinking that I should probably fill out both forms just in case but I would still like to know which one she'll actually need.

Thanks,

Keith & Xiang

Keith & Xiang,

K-visa applicants use I-134, generally presented at the visa interview.

I think this is great news, we will now be able to include the (sponsored) partners income on the I-864 as long as they have a job before they're called for the interview. Oh well...finally some positive news from the USCIS yippeeee

So I assume we should send in the new form then with only 1 year of tax returns? Awesome!

  • 3 weeks later...

Just looking over the new guidelines as we've gotten the visa and soon we'll be focusing on AOS.

As I'm reading the definition of household size on the I-864, household size has been re-defined? It says on the form, "Your household size includes yourself...any dependants listed on your most recent tax return". It says NOTHING about having to count people who physical occupy the same dwelling as you.

Craddy and I will be staying at my mother's house until he can begin working and we can buy a place of our own (can't buy until we know where we need to live!). My mother and my adult sister (she's 28) live there as well but NEITHER is a dependent. They both have full-time professional positions. I know before it was who lived in the house but now would i just have to make enough to cover myself and Craddy? Much like the I-134? We had my mother lined up as a co-sponsor and Craddy had his own funds for that but in the end the embassy said, 'everything looks perfect' with just my I-134 so we're covered there.

Just wanted to make sure. We've got enough between me, my mom and sister by far, but if we can make this as simple and straight forward as possible that would be great.

Thanks! A very happy Joey :star:

And so he did what countless punk-rock songs had told him to do so many times before: he lived his life

10/07/2006 WEDDING DAY!

11/14/2006 AOS packet made it to 'the box' after being overnighted.

12/02/2006 Paul had biometrics

12/14/2006 AOS Forwarded to CSC AND AP Application approved.

01/17/2007 First touch of 2007 at CSC

01/20/2007 Touched AGAIN (also the 18th) come on...

February: Oops, RFE for a REGISTERED marriage certificate. Oops! Overnighted it.

02/28/2007 Paul gets email letting us know his GREENCARD is on it's way! It's done...for now!

03/09/2007 Paul's greencard arrives. And breathe...

We began with mailing the I-129 in on February 27, 2006 so the whole process took us approx. one year.

Good luck out there!
