"Sotomayor has called herself an “Affirmative Action baby” and does not believe her test scores merited her acceptance at Princeton or Yale Law School. “If we had gone through the traditional numbers route of [entering Princeton and Yale Law], it would have been highly questionable if I would have been accepted,” she said. “With my academic achievement in high school, I was accepted rather readily at Princeton and equally as fast at Yale, but my test scores were not comparable to that of my classmates.”'

One would think it would be a conflict of interest to rule on an affirmative action case.

Um, yeah - if she were a firefighter.

Um, yeah - if she were a firefighter.

Or if she were a beneficiary of affirmative action policies... oh wait, she is!

Are there any such cases today?

There have been many in the past and likely will be in the future. Are you suggesting that Clarence Thomas, Ginsburg and Sotomayor recuse themselves and leave cases like that, as a matter of principle, to the white men?

Yes, I think that a wise white male with the richness of his experiences would more often than not

reach a better conclusion than a Latina woman who hasn't lived that life.

there is something to that argument, ya know. nobody likes the guy with the chip on his shoulder in the workplace or church or boy scout troup. the guy with the chip on his shoulder does not think clearly, and is incapable of making a decision in the best balanced interest of all concerned parties. he is too busy getting even with whoever offended him as a child to look at questions rationally.

when i divorced my first wife and won custody of 3 school aged kids the ex tried every dirty trick a police person can come up with to take my scalp. through it all, inspired by voltaire, i held onto "my books". words of wisdom from experts in the field of family systems theory that were written with the interests of children of divorce considered foremost. i pride myself that i was true to the synthesis of their teaching, often suffering so that my children could benefit, and when the time was right, suffering so that their mother could benefit and be worthy of their respect. for 5-6 years things shook out from hell to horizon, and since then have been remarkably good. it was not easy, but it's what a "wise white man" would do.

maybe it's easier for a white guy from a wealthy family that never really suffered to be disspassionate in consideration of the intersets of the lives of a third of a billion people, and to reserve his desire to make special dispensation for perceived personal injuries, because his are slight. maybe this is what a judge of The Law should be, ruling without corruption of schema, ruling in the interest of all as equals, blind to the colour of their skin as The Lady who balances the scales.
