personal Rant - how long do I have to wait for Canada revenue?

Buggers - I have been waiting since April for CRA to tell me I am officially considered a non resident for tax purposes so I can file my final return. I only moved back in Nov of '07 for pete's sake :(

OK - rant done...now I can go for sleepy nite nites (but I still hate CRA)

OK - rant done...now I can go for sleepy nite nites (but I still hate CRA)

I find if you cash GST refunds that you are no longer entitled to, they tend to inform you that you're not a resident in a VERY timely manner. :whistle:

I didn't do anything other than to file my return and in the Personal information box at the top of the return, it asks...when you became a non-resident, and I put the date.

:lol: yep...bet they have no problem catching you then...

I haven't even thought of Revenue Canada yet. Oh my...so much to learn. I know I will be entitled to my GST for July, as I'm not moving until August. And it's direct deposit. So I guess I'd better call them?

I didn't do anything other than to file my return and in the Personal information box at the top of the return, it asks...when you became a non-resident, and I put the date.

in hindsight I wish I'd done that this year - except that I was rated a 'factual resident' for 2007 since I had lived most of the year in Canada and wasn't taxed by the IRS in 2007.

I had to update that for 2008 and they're still hemming and hawing about when the IRS considered me a resident for tax purposes - my last letter to them says Jan 1, 2008 was when the IRS started to consider me for taxes. I can tell you in talking to the IRS, they could care less what the CRA is doing

Because of this - I was taxed by the IRS on my Ei income from Canada last year, but do you think the CRA cares? I mean I didn't live in Canada ...period. I can't file a Section 217 in Canada since I don't know my residency status and the due date was today - oh poop

This stuff is so complicated to me! I came down in 2007 as well and collected EI which I claimed on my US taxes in 2008 when we jointly filed married. But, there was something on the US tax form where we could put that money paid as exempt (another form I think...or schedule) from taxes as I'd paid taxes on that money in Canada (25% that Canada takes off the top of the EI). I had some monies from Canada that I was paid by my employer that year as well, but even with the EI (and you can include what they take off your cheques as withholding) and my wages, I got a huge refund that year, and again, as I said earlier, I claimed that money in my US taxes, but whatever form my husband filled out, it showed that I'd paid those taxes to Canada. They can't double tax you.

Now that I've written all of this, I guess it doesn't matter what I've said now, because the issue was your "residency"...so I ask you this...if you were still a resident when you received your EI, how could they take off the 25%?

Aiy - there's the rub :) I may well get something back once the CRA comes to it's senses and properly calls me a non Resident as of 2008, btu who knows. The EI was earned entirely in 2008 while I resided in the US so I had to report it on my US tax return as World income.....we weren't able to file for an exemption from IRS so got taxed again :( I went on the site Flames recommended and asked my tax questions and they said that I should file the section 217 exemption in Canada to hopefully get 'some' back.

Back to the residency issue - if CRA had made a faster decision, I would have filed the section 217 which was due by today........basically now I've been double taxed on the EI and I can't claim any back...who knows maybe they'll tell me I owe more.....sigh

I don't know if you can just get it in by having it postmarked by midnight? There is no reason you cannot file the return you want to. If you need to do an adjustment later you always can. Personally I would just file the 217.

I don't know if you can just get it in by having it postmarked by midnight? There is no reason you cannot file the return you want to. If you need to do an adjustment later you always can. Personally I would just file the 217.

Electing Section 217 has to be submitted by June 30th of the following year or they will not consider them and I'm at work until well after the PO closes :(

I should have just gone ahead and submitted and plead forgiveness later if needed
