SweetApple08, I can understand the frustration. Were you ever able to reach the TSC by phone. I'ld imagine that it won't be easy to get through to them. My understanding is that reviewing and appproving an application doesn't take more than an hour, but due to the volume of applicants, the delay comes from waiting for your application to "get to the desk" of the officer who would review your paperwork.

I checked on USCIS website and found that the average processing time for I-130 LPR in TSC is 5 months. Given that your paperwork was transferred in November, chances are within the next couple of months, your paperwork should be "under review", after which it would be transfered to NVC. My guess is that when it gets to NVC, things will happen very fast for you guys since your priority date is just around the corner.

If I were you, I would start getting ready for NVC. I would start gathering the documents NVC needs so that there wont be any delay from your side when your case file is transferred to NVC.

The thing is that the beneficiary is already here in US and is on a student visa. The problem we have is to strech the school and be here legally to adjust status. The money is quite tight at the same time (barely making it paying school tuition and rent on one paycheck) and our goal is not to deal with US embassy (they are not nice at all in Albania). That's where the worry comes from. We hope to get something soon because otherwise we would have to pay an arm and a leg again to keep the student status.

I know about the five months Processing Time for TSC, but the tranferred cases from Vermont that were being approved now are of JUNE 2006 receipt date. I just wanted to let others know who are in the same situation. :angry:

Is anyone familiar what happens when the I-130 is approved but the person who adjust status is already here in USA. How long we deal with NVC (what forms are filled out)? When do we apply with USCIS for adjustment of status of LPR spouse - what paperwork they require? Is there any limits on the documents submitted like police certificates (should they be within a certain time frame)? Any tips are helpful. Thanks for your support and sharing your info (really helpful). :thumbs:

Happy new year to all VJ members!

I have both good and bad news for my wife's visa processing!First the good news is feb 19 is their appointment date!Bad news is She just had a baby last dec 4 and I called USA embassy in manila asking what to do with my newborn baby?Somebody told me from US embassy manila to call NVC USA.I did call NVC but they said that I have to call US embassy manila and ask how to process the newborn baby so im lost now and dont know what to do!Anybody can help?thanks

One more problem my newborn doesn't have a birth certificate yet from NSO since He is born only a month ago!hu hu hu....so He doesn't have a passport also!

my advice to try calling NVC again.. i believe they can help you with that.... but for mine, i did went to manila embassy in person and they did help me with it... you should be fine as long as you have all the documents needed for that particular issue.

.... for the birthcert >>> get a CERTIFIED TRUE COPY from the municipal hall where you did your baby's registration, take that to NSO and that they can authenticate it.... if possible get 2 copies or more coz you need that even when your baby is already here in the US.... using your baby's authenticated birthcertificate, you can then file for baby's passport...

I am Japanese and LPR spouse has been maintaining F1 student status in USA.

I think I am same situation as you,

and understand how that is so hard to find a information like our case !

Now then,I inform you that we don't have to deal with NVC !!!

If you plan to adjust status from F1 student to GC in USA , we supposed to deal with USCIS.

Unlike NVC process, we won't get any notice after I-797 approval notice received.

Once priprity be current, we can sent adjustment status document to Chicago Lockbox.

My priority date is March 10 2006, approved I-130 May 27 2009.

A few days ago , I sent I-485 along withG-325a, I-693,I-864,I-131,I-765.

Now's visa bulletin shows our category's priority is March 1 2006.

I talked USCIS customer service person 3 weeks ago for asking when I can send I-485?

They said ' you can send Adjustment of status document now because your priority date is about current '.

Then I went to civil surgeon and collected all document as rapidly as possible.

Finaly sent out package Jan 13 2010 !!!

Oh, and you can start prepairing medical examination ( For me, It took over 2 weeks to be done so frustrating! )

The result valid for 1 year.

Regarding you questions about getting denied, what you are having is pre-interview jitters, so calm your nerves and have faith, you'll be fine !! :wow: I thought we had to deal with NVC (get a visa number). Your tips are very helpful and I will try to see what papers and documents I need to get ready for the application (to have them handy just in case).

After your I-130 approval notice (I-797) you did not get anything from anyone until you actually called USCIS to ask them when to apply for adjustment of status?

Regarding you questions about getting denied, what you are having is pre-interview jitters, so calm your nerves and have faith, you'll be fine !! (and no I personally dont know of anyone who has been denied). So just starting preparing and look ahead to the exciting times ahead for the both of you. Take care and God Bless.

I too think its the nerves and I don't blame you after so many years of waiting can't help but think all sorts of stuff. Just try to be confident and keep answers short to the point. You'll be fine and you'll say afterwards "it was a piece of cake!" :thumbs:

NOA #1: Aug 6, 2007 NOA #2: Oct. 29, 2009 - APPROVED

--NVC--December 12, 2009 - Case# generated from NVC

December 17, 2009 - hubby received his letter from NVC[/font]

April 13, 2010 - received DS-3032 via email

April 19, 2010 - sent back DS-3032 to NVC thru DHL (did not email a copy)

April 23, 2010 - DS3032 was received per operator and reviewed, received IV and AOS bill thru mail.

April 29, 2010 - paid AOS ($70) fee bill

April 30, 2010 - paid IV fee bill ($400.00 each beneficiary)

May 01, 2010 - AOS shows "PAID" in the system, printed cover sheet.

May 05, 2010 - iv bill shows "PAID"

June 24, 2010 - sent AOS via USPS/certified and prioritized

July 14, 2010 - received RFE. nvc is requesting again for Tax Transcript 2009

Sept 14, 2010 - Mailed RFE documents via usps

Sept 22, 2010 - mailed complete DS-230 via DHL

Oct 14, 2010 - received RFE about beneficiary's police clearances

Nov. 30, 2010 - sent corrected DS-230 with correct years of residency via USPS

Dec. 21, 2010 - CASE COMPLETED!!!

April 28, 2011 - interview date was set to JUNE 28, 2011 @6:30AM

June 15, 2011 - MEDICAL EXAM and will be back fri (6/17/11) for results

June 28, 2011 - Interview

July 12, 2011 - arrived at LAX - and we'll live happily ever after!

i once talked to a lawyer about that and he assured me that this is an LPR's right to take his spouse to US. so dont worry about that!!
