anyone LPR who file i-130 for spouse...

Hi friends,

I am new to this forum and its a very helpful place for all of us.

I am so confused with the following question on I-864. please help me.

I am a LPR filing for my wife and kid. my household size is 3. so, according to poverty guidelines, I should have at least 22k income. my last 3 years income is 19k(2007) 18K(2008) and 24K(2009). SO, I AM NOT ABOVE THE POVERTY LINE IN 2007 AND 2008. my current income is around 25K. BUT,I DON'T HAVE THE PAY STUBS FOR LAST 3 MONTHS AS I WAS BACK HOME WITH MY WIFE AND KID.

do you think this will be a issue? whether I should list all 3 years income in the I-864 ? please advice me.

actually kuraish, we didn't even fill up the last two year income and last years income, coz what's important is the recent income as per CO last two year and last year's income are no longer applicable for what matter's the most if the recent income. and as per pay stubs just give them the last 3months pay stubs and the last three months so it can be 6months in total yes, it may not be that recent for your pay stubs and again as per CO when we asked about pay stubs he said anybody can just make it out and print it out what matter's again is the recent income, w-2 and he added that since you have provided them with your ssn nvc and COs will check it from there. they will go over your ssn. and from there they will see it. and ask for employment's certificate it is a very big help as well.

you don;t need a lawyer on this one even i my self the beneficiary did this from the start and my hubby the petitioner just sit there and just paid the fee bills... while all i know for a fact that every one here in this forum are the petitioners... they even made this all possible and has reached case completed without hiring lawyers at all.. again take it from me the principal applicant (beneficiary) did this processing all by myself. :)so i bet you too can do it! no need to hire a lawyer it's going to cost you a lot. and all they do is ask this and that papers which everybody here in vj did. so i am pretty sure you can do it yourself just put your mind in the right track and a help of a prayer that should be it:)

I didn't hire a lawyer on my forms, its ok but sometimes tricky though..but u will be fine filling out the forms.. if u have any concerns u can always ask our fellow VJ'rs here..am sure they will be more than happy to help all of us here.. goodluck and God bless

Im sure you will receive a letter by the end of month. By the way are you ilonggo? my husbang is from iloilo but he grew up in cavite so he never really speak the language.

hi shallom, on my opinion... they wouldn't mind asking your spouse with all of these questions mostly they will just asked about when they got married and birth dates...

as to that questions it is more applicable to fiances/ees. coz what matter's the mosr for COs are marriage certificates and date of births and when they got married. :) no offense.. but of course there's no harm in studying those questions :)

THANKS RAYMON. A QUICK QUESTION. DO YOU THINK I SHOULD MENTION ALL 3 YEARS INCOME IN THE I-864 FORM? IS IT REQUIRED OR OPTIONAL? I WAS THINKING TO LIST ONLY MY 2009 INCOME AND SEND THE 2009 TAX TRANSCRIPT. WHAT DO YOU THINK ?

Its really an optional thing since what they really wanted to verify is your recent income; but we always wanted everything to be perfect,

so that is why even if its optional we just send anyway just to avoid the dreaded RFE.

Like i said its optional and its your choice.

So cold? hahahahaha...you wait till December and January kay labaw pa sa cold..one good reason dont like to live up north. Im here here in Dallas, TX and we do have our share of winter as well but not as BAD as up North. But ive been to Seattle before and city is pretty nice...

Hello Guys ,I have been reading here a Lot about EMPLOYMENT CERTIFICATE while sending the AOS,Can sum1 plx explain me what exactly it is n what all points does it cover?

Certificate is simply a proof that you are currently employed. It usually indicates your length of service and position in the company you are working; and some certificate may or may not include your salary.

You may have to get in touch with HRD to get one.

hi missy, to be honest?? im not done yet... i mean i was just like you which i was sooooo stressed out and even going insane already... i tried to hire a lawyer but good thing my mom's friend which i was trying to hire and should be doing all the work for me told me that i can do everything by myself and all i have to do is to layback and not to think about it tooooooooo much...

im still trying to finalized everything... i already all the docs that i needed but im just being lazy and laying back too much i guess...but im almost there.... just to make the whole packaging that ill mail it out as soon as im satisfied with it.

hi riz, you will need to submit a photocopy of the approved petition the one with priority date already, birth certificate of your daughter, and a request stating that you want to include your daughter(derivative beneficiary) in your wife's petition. you may send it thru email or you can send it thru snail mail your choice. :)

admire, please don't loose hope i am pretty sure that whenever you can provide the certificates of divorce papers from oyour hubby everything will be a smooth sailing... how i always want to ask questions regarding how our family's interview here but sad to say that i can't always keep track on how things going... i know how it felt too when they asked you so many things coz i have encocuntered one the same situation as you do (wife of my cousin on which she had a previous marriage and their cert of annulment was not completed yet) so i can feel your downside... but please pray this is for you and your children and your family as well. keep it up. i'd like to add that i too was in and out of the embassy as well.

chakadoll, i will never forget this site coz i have encountered the same situation like we all do-away from our loved ones... that's why every now and then i want to make sure that everything here is fine and will add more info as much as i could whenever there's a question for me, neither i have questions too.. and good luck to your up coming interview! reminder just SMILE!

lynn12, wow that was fast! i can't believe you will no longer wait like any other here in vj who's been waiting 3-5 years. by the way are you a spouse of a legal permanent resident or a spouse of a citizen? coz if you are a spouse of a citizen then no wonder why. and lynn,about after paying the fees you need to follow the instructions and send it back to nvc, just provide them with the dox that should be it.:)

ekto, we got the same thoughts about lynn's situation... (and okay scrolled down and indeed an LPR and yes from HAITI so no wonder of course from that tragic that happened they will really get a priority and they desserve it.)

alit, so nice to hear that he will be coming back soon to travel with you guys but don;t you think that it is going to be expensive and costly? i mean don't get me wrong ha but it's too expensive to travel all together and the needs that you will be spending whenever you guys arrive in america... don't get offeneded on this one but it is only my point of view... :)

glieswayz, yes it is normal for this moment of processing compared to what we had before and it's a good thing:)

clav, you need to patiently wait for that, actually ds3032 (choice of agent) is only a notice or authorization that your beneficiary chose you to be his/her agent so whenever nvc will contact the beneficiary or applicant it will be easier to communicate with the chosen agent. :) good luck! so what you will be waiting in your email is the aos fee (affidavit of support fee bill) and everything will follow just need to be attentive to the required dox to send back to the nvc to avoid delays.

please bear with me guys... this is the only and easier for me to respond all fo you :) and no matter how long this message of mine still i am glad to help you guys to the best that i could, i may not be able to help all of you due to differences to our situation but i want to to the best of my knowledge. mitch and raymon and to all, you guys are such a great help to everybody :)

good to hear from u Yna, yeah i know it's really expensive if we will travel all together. We also consider that he will just wait for us there coz the processing is really fast. Before he left we think that we can be there in US early next year, but yesterday a new visa bulletin comes and for F2A it's already July 2008 while ours is Sept. 2008 so its only 2 months difference. Now we really believe that we might spend xmas with him and that's just a couple of months from now so we have not enough time to save enough money to travel all together.
