Hi, LPR Family & SweetApple08

---let me sum up my situation :star: ---

I am F1 student, Married to LPR, living in USA.

I-130 petition filed March 2006, priority date is March 10,2006

Approved I-130 May 27 2009 ( I-797)

Sent out I-485 on Jan 13,2010.

---------------------------------

Little bit of bad news for me...

I received Rejection Notices from USCIS. :crying:

They sent back all document and fee check with I-797C Rejection Notice (each notice attach to I-485,I-765.I-131).

The Rejection Notice of I-485 said,

' The check amount is incorrect or not has been provided. The correct filing fee is $930. --abbr.-- also include an

additional $80 fingerprint fee.' ( I sent correct amount of $1010.00...)

' Based on the information you provided, your priority date does not appear to be current. --abbr.-- When your priority

date is earlier than the correlating cut-off date listed in the current Visa Bulletin, you will then be eligible to submit your

I-485 application.'

Other Rejection Notices of I-765,I-131 said, ' The check amount is incorrect or not has been provided'

:cry2:

So, I should have waited to send document till my priority date become current !

Even though USCIS person told me that I can send them now... Oh, yeah, I can't trust them anymore

I know It's gonna be soon to be current and I will be able to resubmit.

But still feel pretty bad  ,because my priority is only 10 days behind the Visa Bulletin!

(now it is March 1 2006, mine is March 10 2006 ), result is that block me off ...

I have to redo my paper work with lack of energy .... sigh ...

To SweetApple08 (L)

Regarding your question, yes,I did not get anything after I-130 Approval notice.

No contact from anywhere made me worried and called both NVC and USCIS

(also e-mail to NVC for inquiry), then figure out the procedures.

I am still attending school and keep maintaining I-20.

Once I get a NOA for I-485, I am going to stop attending.

I will update again :star:

Thank you Nekomyu and welcome in VJ :)

I am so happy that I found someone in here who is the same situation. Your application is getting very close to finally get the GC and free yourself of the "student status" Thank God!

I thought we had to deal with NVC (get a visa number). Your tips are very helpful and I will try to see what papers and documents I need to get ready for the application (to have them handy just in case).

After your I-130 approval notice (I-797) you did not get anything from anyone until you actually called USCIS to ask them when to apply for adjustment of status?

I talked USCIS customer service person 3 weeks ago for asking when I can send I-485?

They said ' you can send Adjustment of status document now because your priority date is about current '.Where you looking at the Visa Bulletin and estimating the time when to apply? How long before it becomes current can we apply?

Do you have any idea when you can stop attending school as an F-1 student? (I think I have read somewhere that it is after you receive the first NOA for I-485) is this the case? Right now are you going to school or doing OPT?

Keep us updated! Wish you good luck in getting an AOS approval fast. :D:dance:

hi samkunle! i have a prob regarding my address number, coz when i receive my NVC approval, the address is #022 malasin street, it shoul be #0226 malasin street...me & my hubby is worried, coz it might be a prob in the future for my interview or so, he try to call NVC & correct it but the number he dialed 603 334 0700 is always busy....

Jeanette, IF the primary means that the NVC communicates with you guys is by Email, then it shouldn't be a problem. My wife's address with the NVC was also entered incorrectly (the state my wife lives in was spelt wrong: "Kuduna" instead of "Kaduna"), but I didnt bother contacting NVC to correct it since all correspondence has been by email. But if you are really concerned, tell your husband to type up a letter and mail to the NVC pointing out the error. Remember to include the following info in the letter:

NVC Case number

Petitioner's full name

Petitioner's date of birth

Beneficiary's full name

Beneficiary's date of birth

Hey SamKunle, I may be wrong but you seem well knowledgeable about NVC process. Well, I'm a LPR, did file for my wife and kid with PD Nov 24,2006. Got approved in May 29,2009 and received case # from NVC July 21,2009.

It seems some guys with PD in December 06( wow !) are getting DS 3032 and I-864 Bill. I have been checking my mailbox too.

What documents were required for your kid ? I have 2 boys, 13 and 2. Did you have to send your kid copy of passport as it's required of the Primary beneficiary ? Yes I visited LingChe and James short cuts. Hope reading from you soon.

Wishing your family smooth interview

Thanks Shallom. I want to believe you should be receiving DS3032 form and AOS bill sometime soon since a few Dec '06 "priority dates" have received theirs just last week. I hope you have provided NVC with email addresses of yourself and your wife. NVC prefers email communication.

To your question, I submitted a photocopy of the biographic data page of my son's international passport with the DS 230 forms.

Wishing you the best in bringing your family to the US.

Hello Jeanette, the only bill which needs to be paid before sending the I-864 package is the AOS bill. The IV bill is for the DS-230 package.

As per the the choice of agent request, NVC will send you an email to let you know that they have accepted the choice of agent request. Another way to know it has been accepted is when the IV bill is generated or activated on your account.

With regards to why the cover sheet shows blank, I have no idea. Let us know when your husband finds out what's the reason.

Hey Shallom Hi,

the thing is you have to send ALL your documents in their original form, and you also send in photocopies. Be ready to send in the original or Certified True Copies of your Marriage Certificate, Divorce Certicate (if any) Beneficiary's Birth Certificate, Children's Birth Cerificates, photocopy of beneficiary's and children's bio-data page of passport, and any other document you deem necessary for your application.

Hello pples, happy to let you know that our choice of agent has been replied to as being accepted. We have also paid the IV bill. I am so so happy to see the end in sight. Pls hold on just a little while longer everybody, it'll soon be here.

Butterfiylove, am so thoroughly going to go through your poems! I love the way your mind works.

Who was that talking about Choice of agent, my advise is call the tel line and speak with an operator, they'll tell you exactly what is going on.

I called them the other nite they said they were yet to receive it, then i called last nite and the guy said they just received on the 26th and that it takes two day for it's review and acceptance after which my IV bill would be generated. Woke up this morning, and alas, there it was !

So...call them and speak with someone.

SAMKUNLE, thanks for the text, hope u got my reply? MITCH, yes, i mean it too, it'll be great for us all to meet. Let's keep it in mind.

Hello everyone,

reading through this just brought this question to mind, i would really be grateful if i can be given honest and constructive replies. I had always wanted to know if any past non immigrant visa applications from a beneficiary, weather denied or approved is put into consideratin when dealing with the said beneficiary's immigrant visa petition.

Reason being that in 2006, I did make an application for a NIV and didn't write out my husband's usual names when they asked for spouse's name, i gave his last name and his birthdate correctly though. all that was just in a bid to confuse them from knowing that my husband was a legal permanent resident so they wont deny me cos of that. But they did deny me anyways, and it was much after then we filed for the i-130.

Pls have u ever heard anything like that? What do u think? will this come back to bite us???

Hey Shallom Hi,

the thing is you have to send ALL your documents in their original form, and you also send in photocopies. Be ready to send in the original or Certified True Copies of your Marriage Certificate, Divorce Certicate (if any) Beneficiary's Birth Certificate, Children's Birth Cerificates, photocopy of beneficiary's and children's bio-data page of passport, and any other document you deem necessary for your application.

Shallom, I hope this answers your question.

Admire, congrats on the progress being made! It must feel very good. And yes, I got your text message.
