Hello

I need a co-sponsor since I only started working since last year and I have filed tax return for one year only. Do I have to file I-864 and my co-sponsor fills I-864A or both of us fill I-864? I'm confused between I-864 and I-864a.

You both need to fill in I-864.

I-864A is needed if another member of your own households income is being used to sponsor the immigrant

:yes: I had only worked one full year and was able to sponsor my husband solo for the AOS process. Was your income last year above the poverty line?

All you need is one year tax returns (2005) if you are not self-employed. Are you 125% over the poverty level?

Yes, I earn way more than poverty level, but instructions say you need previous three years of tax returns. I'm concerned if only one year of tax return would be enough.

Someone posted a USCIS memo recently that said that only one year's taxes were needed...ah, here it is.

But, we adjusted status before this memo, and we turned out ok. I did turn in 3 years worth of taxes, with the first 2 years being very low (college student cafeteria income) and one year where I made above 125% of the poverty line.

The new I-864 only requires 1 year of tax returns (but 3 years can be provided if you think it will help your case) so as long as you made above 125% on the past years return you should be fine :thumbs:
