Hello All,

I am new member on this forums. I have couples questions about filling I-864. My father petitions for my sister and her family (5 persons). My father got AOS fees $70 and he already paid. My father incomes is not enough for sponsor when he filled I864. I will be co-sponsor for my sister. My father and I live in same house. My questions is

1. Which form should I fill I-864 or I-864A

2. I and my wife file tax together so my wife need to file anything on Sponsor documents?

If you adding your income, you would use the 864a.

If you are sponsoring with just your income, use the 864.

If your wife is using her income to sponsor (she would need an 864).

But since you are just using your income, no worries about the wife. (you will, however, need to count her as part of your household)

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

If you are going to sponsor only your sister (1 person) then you would complete an I-864 for her only. If you are wanting to combine your income with your father's then you would complete an I-864A.

If only your income is being used, then your wife's income and information does not apply. Even if you file taxes jointly you will only show your W2, 1099, etc. along with the joint return. If your wife's income is included then she is completing an I-864A and attaching all of her information.

Thank you Bobby and Anh Map for fast reply. Another the question on the Form I-864 in Part 3 question 8 and 9 and how do I fill on that questions

1. If my father sponsor for principle immigrant and 2 person what check box that he needs to check?

2. If i sponsor for the rest of person in my sister family which check box I checked

Father checks YES for 8 (sister is principle immigrant) and checks 9 and lists names of those he is sponsoring.

You check NO for 8 and check 9 then list the names of those that you are sponsoring. You CANNOT combine your income with anyone else as a joint sponsor. So you wife cannot be a part of this I-864.
