7 months in the wait and I FINALLY get an email saying card production ordered.

Every step of immigration has been smooth sailing, this is the only time I have hit bumps and waited so long, I guess we all have to feel the pain at some point in the process.

I am hoping it comes before I move... I doubt that. I move this weekend we have our place until the 20th... I have had all mail forwarded and changed my address online. Such a pain though.

Well, I'm facing down the barrel of ROC. FML.

My card expires in Nov. Ugh. UGH. I do not want to go through more immigration crapola, as I haven't gotten over the trauma of the last batch!

I'm terrified of the evidence requirement, because my lovely, intelligent, resourceful, loving, wonderful spouse likes to THROW OUT MAIL WITHOUT CHECKING WHAT IT IS. Including our tax refund, which we had to re-order. All those cards sent to us by our families? Gone before I could save them. I have fished a few out of the trash if I spotted them, provided they weren't covered with vegetable peelings or coffee grounds, but I haven't seen them lately so I think they've been purged too.

We'll have our lease, our bank account which both our paychecks automatically are sent to, our joint credit card, our tax info from the last two filings, and him being on my dental insurance. That's it. :help: Utility bills, phone, internet, etc are under his name, I don't drive so I am not on his car insurance (his parents pay for it, anyway) and are have the aforementioned dearth of cards and such from his family. I could probably scrounge up another card or two in the next few months, and his parent's church sends us newsletters addresses to the two of us because we're not living in sin, and we could print out the expedia travel confirmations from our yearly christmas trips to visit his family, and from our vacation in Canada last summer, where I have a single picture of us in the ROM (which was included in our ticket/hotel/entertainment package). We have lost the boarding passes, so all I have is the travel confirmation emails, will that work?

18/05/2008: POE - Harassed by ignorant and incompetent Customs Official who grilled me until I answered that the reason why I broke up w/ my Ex was not to date my USC but b/c he was "impotent from a porn addiction". He also insulted my husband's motives for talking to me, dismissed our 2 years together as "not enough to get married", and otherwise trotted out the Spanish Inquisition.

Put yourself on the utility bills now, I had about the same amount of evidence as you and they sent an RFE.. it just takes a phone call!

Put aside a box now and TELL your husband to throw the mail 'garbage' into THAT box and you will sort through it, collect out what you need and throw the rest away.

I live with someone who does exactly the same thing - often throws out mail unopened believing he knows what it is when he really doesn't, and who knows what he has lost because of that- until I started intercepting the mail on its way out. I felt uneasy at first opening stuff with his name on it (and it is only the business looking type stuff, not the personal stuff which he does open) but through that I have discovered that they raised the amount on our mortgage due to tax increases and he was delinquent on that paying late fees that he didn't know about for nearly a year because he threw away the notifications from the mortgage company, found a $300 refund check that he didn't realize he qualified for so wasn't expecting, threw away rebate checks he had applied for and forgot about, threw away free subscriptions to magazines he actually subscribes to, threw away a notice of power service cut off because he missed a payment (actually, he had sent the request for the bank check to pay the bill and the bank messed up, but the result was the same as if he hadn't paid) and literally the day before they were to cut off the power I discovered it and we made a quick trip in person to pay the bill. There have been other situations like this so I really do appreciate what you are going through. (In my husband's defense, I can appreciate his position that it is all junk because 90% of it is junk - I am astonished at the amount of unsolicited mail that is sent out in the US!) So, now, I'm the one who opens up everything he decides is 'garbage' and then throw away what really is garbage. I also keep the files for all the papers, so maybe you could offer to do that - it gives him an added benefit to letting you do the mail.

The up side of this is that from now until you file for ROC you will have a chance to collect and save other documents that you might not think about as evidence because you intercepted them.

If he is reluctant to do this ask him how important is it to him that you are allowed to stay here? Ask him if it is too much bother for him to follow this simple process of putting the mail in a box instead of throwing it out how much more bother would it be for him to move to Canada with you when the ROC is denied due to lack of evidence? (Ok - not that I think there is much danger of that happening but sometimes you need to frame things in stark terms to get the message across).:D

Think creatively and outside of the box - have you listed him as a beneficiary on any pension plans you still have in Canada? Are either of you listed as 'emergency contacts' at work/school? Do you receive any subscriptions to magazines? Do you have a joint membership in places like Costco or for movie rentals or something like that? You can also get affidavits from his parents, from other family members, from neighbours, from friends, and even the Pastor at your Church, stating that they have known you since you were married and that the two of you live together as a married couple at such and such address, etc.

With the joint accounts, credit card statements, etc., go through and find ones that show activity by both of you on the same statement, and include statements that cover the whole time period of your marriage (in other words, not just one statement but several from different times). Include the trip itineraries and write on them that you no longer have the boarding passes. You could also write your wills and include copies of those.

You still have time to collect a good representative sample of evidence - if you can get him to let you make the final disposition of the junk mail :) . Good luck.

Good stuff

Most of the things you mentioned, like pensions etc, we don't have, but you reminded me that we have a Blockbuster rental account that had to be set up with both our names because they wouldn't accept my GC as ID, only a Driver's License (which I don't have). He's listed as my emergency contact at work.

I can send out a request that people (his family and mine) send us cards for our 2 year anniversary, would that help?

Hm, we have a joint gym membership too, would that count?

His brother's wedding is this summer, so I plan to get a ton of pictures of us together with his family. I know that photos aren't primary evidence, but our primary evidence is pretty serious (like the joint credit card. Now THAT is good faith!!) so I am hoping that we can pelt them with minor stuff to supplement the major stuff.

My mother also flew down to visit us (on our joint credit card, it was our gift to her) so I am wondering if I should include that as well as it's evidence that our families are well aware of us living as a married couple at this residence.

What do you think of these extra bits?

Yep - that's what I meant by thinking creatively :yes:. The 'little' stuff like that is not likely stuff someone trying to prove a green card marriage would have or submit. It is part of the day to day living that shows how you have blended your social and personal lives as well as your financial lives, so definitely include things like that too.

Hi,

I have a divorce case similar to yours.I got my green card approved(had my Conditional Residence Visa),it is now valid only for 2 years till June 2011.Things didnt go on as expected and my husband mostly wants a breakup.I landed in US on Jun17 and by Jun 30 he made up his mind.Now,even though i am legally married,i am not living with him.Can anybody let me know what will happen to my visa status and if i can prove my marraige happened in good faith.How can i get a permanent residency now?
