CR-1 & K3 filing

Timeline

Hello to all my fellow filers. We have been denied the K1 visa from Guanzhou, since the denial we have married in China. Looking for clarification for the cr-1 and K-3 filing. Do I file the Cr-1 first, then file the K3 after? and if so how long after if this is the case. Thank you for your advice.

If you are going to take the K3 route...yes you have to file the I-130 petition first and when you get the NOA1 then you can send your I-129 petition with the notice of action. But based on the processing time now, k3 is obsolete already since CR-1 moves faster now...both petitions get approve at the same time. The only thing that matter is the NVC point, but if you have all the documents ready then you papers will be completed at the NVC sooner. I suggest to stick with CR-1.

If you do not fix the underlining issue, (depending on what it is) any other visas will be denied.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

Thank you for the response. The reason not a bonified relationship, standard white letter. I can only assume the lack of english was the problem, we are taking steps now with this, i am teaching online everyday now with my wife.

I will file the cr-1 form, does it make any difference if i file the the K3 at a later point?

CR-1 would be the route you would need to take. (the most recommended)

You will have to really try to fix that bonafied relationship concern, that could stop you, even if married.

Pushbrk could probably give you a clearer answer.

Thank you, I agree if there is a problem, this needs to be addressed. on the cr-1 do you front load the paperwork?
