Normally I block your posts RebbecaJo, but I thought I would see what gems of wisdom you had. Uh huh. Now I remember why I blocked them, just need to remind myself every now and again. But I suppose your advice and guidance will help the OP on her quest, maybe give her a giggle. Yes, all and all, a very useful post of information.

Ok...I am still confused...so please bear with me.

My fiance (from Holland) just received packet 3. In it, it has an affidavit of support form. From what I understand here, I don't need to fill it out until after he is here and we are married? Then why did they include it? I am so confused.

I don't know what to do about my joint tax returns still, and now have another question in regards to the 125% over poverty level. The charts talk about how many people are in your household. Well, there are 6 people living on my ranch. My ex-husband, my two adult sons and one of my son's best friends. We all work and support ourselves. They are all saving to move out (someday soon I hope...lol) but in the meantime, my ex and I are the ones paying the bills. Please don't go into what rent my kids should be paying me. It isn't what I am asking about.

I want to know if I have to take into account everyone living here, even though we all pay our own ways for food and things. And of course my original question about my tax forms.

You do need an affidavit of support for the K visa. This is the form I-134. Very similar to the I-864 that will be used at AOS. Most consulates apply the standards required for the I-864 to the I-134.

Regarding household size this is who you claimed as dependents on the last tax return. In the case where you are divorced then the ex would not be included in the count, but any kids/persons claimed as dependents would be counted in the household size.

AOS = Adjustment of Status (done after marriage in US); Maybe you think it is Affividait of Support, and that was part of the confusion.

Gary is at times obnoxious. But I'd rather someone help me be "prepared for the worst and hope for the best."

Not sure how the consulate will deal with a joint return when only you are sponsoring. I'd inquire about doing something single and even your YTD 2009 info. At the same time, Amsterdam may ask for none of this -- no one can predict. See quote above.

Thanks. I DO appreciate the help...just not the attitude I perceived. Anyway..moving along...I AM going to talk to my tax accountants, probably tomorrow to see what, if anything I need to do now.

I also realize the difference between the Adjustment of Status and the Affidavit of Support. Somewhere in the glossary, here on VJ, I believe I saw that AOS can be used for both. My confusion is due to the fact that the Affidavit of Support came in Packet 3, and I would suppose that means we have to return it, or he has to take it to the interview. I guess their will be a list of things to return when we crack open the packet this weekend.

Gary, I do appreciate the help, honestly. However, you come across as harsh and as I said before, judgemental. There ARE ways to talk to people to get your point across which are far more effective. I have worked with my oldest son on this for many years as he has Aspbergers Syndrome and tends to come across the same way. What makes it a problem, is that due to that very fact, many people tend to immediately turn a deaf ear to him....even if he is right.

Well, Blu, sorry if I come across that way. I do not think my first response did so. Then of course the entire argument ensues about taxes for which I had no doubt or I would never had said anything, then the fiance rides to the rescue (points for chivalry!) with his analysis of the US tax system (i guess he will learn about that when necessary) So basically the level of tone increases.

Tax accountants do illegal and improper things all the time, just like attorneys do. How many times have we seen people here tell us their attorney tells them to have a fiancee enter on the VWP and get married and adjust status? I mean, I cannot even count the messed up visas handled by attorneys that get reported here. I believe you did not intend to do anything wrong when filing your taxes. I really don't care if you did because I trust you to spend the money you earn more wisely than the government anyway. I believe you have a legitimate and genuine relationship with your fiance, and his lack of knowledge of US tax law is understandable. I believe you will probably get his visa (Amsterdam is hardly a difficult consulate to deal with) and I believe you (he) should be prepared for the worst that your unique situation could present.

And I believe your questions have been answered...at least to this point. So I shall bid you a sincere Good Luck.
