The embassy clerk told us that my US husband should be living in US and send an AOS to me.(I-864).In your case,did the american spouse have to be in US to do this things?If we can prove residence waiting in US.?

USEM Manila may very well require that the US cititzen petition actually take up domicile in the US before they approve his I-864, and your visa with it. I know that Bangkok is very strict about this as well.

Your Consulate may have this as a policy, which doesn't not leave you a choice.

Hi.. What do u mean, we are only 2 .me and my american husband and we are going to get a sponsor bcoz his ansual income did not reach the ir required amount ...he is getting it from his SSS bcoz he is disble had back problem injury so cant work by now... his annual cost only $14,320. So does that means it should be $14,32 x 2?

Hi! We have the same concern. My american husband also doesnt want to return to the US unless i get my visa approved when we file it. He is staying ith me for 10 mths after we got married 9 mths ago.He dont have a job but receiving a SSS pension bcoz he is disable got injured outside service and not inside us navy service during his term. He dont have pension only from SSS supporting him. So we want to be practical, its expensive going and coming back for him here. We will have a joint sonsor 1-864 to reach thier 125% rqmt. Where u in the pils/ we are in cavite.

1. No problem, my husband was unemployed while in Ireland and did not file tax returns. He simply wrote a short statement that this was so, signed it, and it was accepted in lie of tax records.

2. We also did our DCF on assets; as long as he can shopw they are easily liquidated if neccessary, that should be no problem. Surely he has some sort of pension though? That would make things even easier for you.

3. Does your husband have any ties back home, such as a US bank account, valid driving license etc? That should be enough. He can also establish a US mailing address by having a bill or some papers sent to a friend or family member's house.

4. No, only you as the beneficiary will need police clearance.

5. Each consulate is very different; as you can see from my tiemline below, it did not take me long, but it can take up to 6 months. Try to find some Philipines DCF timelines on this site for more info on this.

The person I recently helped with his DCF in Manila had a bank account, owned land and had a telephone number and mailing address at his brothers. He didn't move to the US intil after his wife got her visa. He was here for a month before the interview and went back and attended it with his wife. I guess you could say he has moved already. He'd shipped a lot of stuff also.

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship
