Hi everyone of this forum , need advice and guidence

i am a citizen of india and my case is as under

my mother has filed my petition under Family based immigration category F3 in Feb 2005 , Earlier to this

my mother went to USA on F4 visa which her brother had filed in 1986 and she got her visa in Dec 98 , i was also included in that petition and so i had submitted my finger prints and other document with my mother , but when my mother had received her visa call in Oct98 i had just completed 21 years and 1day so i was not included in that Visa interview call and i could not appeared for the visa interview , after that i got married in india and my mother went to USA in Feb 99 , she become USA citizen in 2005 and filed my petition under F3 including my husband and my 2 children ,

my question is since in Oct 98 i just missed my VISA interview due to i was 21 year older by one day and i had finished finger print submission also , can i request for the faster processing of my F3 petition which is filed by my mother in Feb 2005 ?

if so , what is the process for the same and what kind of documents i have to submit to prioritized my case .

anybody know any process please advice

The new petition for you can not retain the prior priority date. You did not qualify in 1998. That's the end of that petition for you. You have a new petition for you in 2005 and that is now your priority date. Sorry.

The new petition for you can not retain the prior priority date. You did not qualify in 1998. That's the end of that petition for you. You have a new petition for you in 2005 and that is now your priority date. Sorry.

yes aaron2020 , you are right but is it any way i can request USIC to accelerate the processing of my Nov 05 F3 petition , since i just missed earlier in petition due to ageout

No. USCIS cannot accelerate any petitions in the family preference categories. The original petition was not for you, it was for your mom, and you were just a potential deriviative beneficiary. Now you have to wait like everyone else in your category. USCIS by law cannot give you any preferred treatment based on the petition for you mom.

There is absolutely nothing you can do or request to be done at this point. You have another 4-5 years before you Priority Date will become current. You will have to be patience and wait.
Thanks Dear , Thanks a lot , i think since the petition filed in Feb 2005 it will take onther atleast 5 years
