I have a question. I know another woman who is planning on having her Nigerian SO get a visitors visa and then "marry as soon as the plane lands" and try to adjust status. There is a 20 year difference between their ages. What do you think the chances of success are . I told her I thought it was a very bad idea.

Not only a bad idea, but he quite probably won't be given a visitors' visa.

That is what I was thinking also , but I know he has travel experience in Europe so he has the connections to get a visa. And Nigeria is a very connection oriented country. It is really disappointing that this back door exists. It gives a sense of unfairness to the process for those that are doing it by the book to see others just skate through the back door.

This will not be over quickly. You will not enjoy this.

Nowadays Israelis are not having easy times getting tourist visas either so good luck. But I still think what you're doing is unfair.

Why do you say that? Any evidence to support this position?

In my experience Israelis who demonstrate sufficient ties to home are issued tourist visas fairly routinely.

Please note that this thread was stale (from June), and then revived today. The OP is likely not monitoring it. Anyway, he didn't do anything "unfair". He asked a question, got some responses, and even posted some followup that indicated he got the message that intentionally entering the US with intent to marry and adjust was not fair game. We don't know what path he'll actually pursue, but he didn't state that he intends to violate any law, or that he has done so.

Because I know 32523632464354 people from there who haven't been able to visit their families and friends in the US. I have friends married to peeps from there....friend's brother was rejected even though he is in good standing, and she was supposed to have a knee operation...still wouldn't let him come. Oh but now I realize that writing about things I've read or heard from others is not cool and that I should go directly to the govt to get these statistics and post them here when I make a post.

And yes I note that the thread is old. I still think what he was attempting to do is not cool.

Connections don't seem to work with the U.S. Consulate in Nigeria.

Our time line for CR1 visa took only 5 months and 1 week or 156 days; from the filing the I-130 on the 03-12-2009 to Approval of NOA2 on the 05/13/2009, then Interview on the 08/18/2009 at Manila, Philippines. We had a daughter on the 11-12-2010 named AISHA JOY means HAPPY LIFE.a1_opt-1.jpga2_opt-1.jpga3_opt-1.jpg

Do you have proof of this? Having 'travel experience' outside Nigeria does not get you a US. Visitor visa in Lagos or Abuja . Visitor visas are hard to get in Nigeria and I wouldn't count on him even getting a visitor visa unless he has a really good job and a very healthy bank account plus some landed properties. The CO's know about the culture in Nigeria and their age will difference will definitely pop up at the interview(if they go down the k1 or k3 route), am Nigerian and I know most Nigerian families will not like the idea of a man marrying a woman that much older than him. But to put your mind at rest, there is no back-door or connection business when it comes to the US embassy in Lagos.

I am in search for an answer to this situation:

My future wife lives in Israel. After I met her she got a tourist visa.

As I learned from the statistics, completing fiance visa takes about 8 months; and as of now fiance visa is out of the question as a very long process.

Can you please tell me if it is going to be a problem to get marriage certificate in US and apply to change her status from tourist to resident once she comes to USA?

How soon can she get documents as a permanent resident?

She has no intent to go back in the near future.

No problem. What you are proposing is called Visa Fraud. The worst that can happen is she gets a lifetime ban from the US and gets deported.

You can follow and have a nice life somewhere else.

Well, assuming he can get teh visitor's visa, what they are proposing is no problem. There is a name for it actually; it's called Visa Fraud.

Now, when Immigration finds out what they did, he will most likely be banned for life from the US and be deported back.

She can follow and have a nice life together.

He may have all the connections in his country, but it is the US consulate(US citizens working as consular officials, and making visa decisions) that issues the tourist visa and no amount of 'connections' will get you a US visa if you do not meet the qualification. IMO there is little change a young(or youngish) unmarried man from Nigeria will be issued a tourist visa. I could be wrong, but the odds are against it.

It is what we called, "immigration fraud".

Visitor visa is supposed to use only for visiting purpose.

If somebody comes into U.S with visitor visa for intention of marriage/staying in the U.S., he/she lies to immigration officer at PoE.

That's big deal in U.S. legal system.

It will catch the red flag for every case they deal with USCIS.

If they pass one hurdle, that doesn't mean they will be safe.

It will bite them at any time.

Very bad idea....

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

Not quite with "no problem".

The lawyer stated that there could be a problem. (With intent) - marrying within the first 90 days of visiting.

Also - the caller had a seperate problem, he is a "tax protester" who doesn't file taxes. I doubt that would fly with the USCIS (since you have to explain to them why you do not file taxes)

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.
