Queston on background check for petitioner

Hey,

I have two failures to show to court for minor violation offenses in NYC (I am the petitioner). I was just wondering if this will cause a denial of my I-129F petition? The one violation was for an open container ticket in the parking lot of Shea stadium while tailgating in 2005. The other violation was for crossing through Washington Square park in 2007 after the park was closed. These were just violation charges, not misdemeanors or felonies. I was in school at the time in NYC when I got these summons but never showed up for court having no time or money being a student and working two jobs (plus if you live in NYC you are bound to get a violation ticket for just about anything so no one takes them too seriously...). Now, I have been able to obtain a passport in 2008 to travel to the Dominican Republic also I have been pulled over by state and local police for speeding since the other tickets and the police never mentioned anything about a bench warrant in NYC. and I also had to file for a professional license in the state of New York in 2007 ( they will not issue a professional license if you are a criminal) So I don't think these missed court dates constitute me as being a "criminal" but I worry that this could some how affect my petition. I have asked this question in the K-1 forum when I first joined VJ in May (Yes, I know stay out of the K-1 Forum) but got no solid answers and someone else hijacked the thread with their own question. From what I understand my "criminal" background does not apply unless It falls under the IMB act, Adam Walsh act, or if I have had 3 or more convictions of alcohol and/or controlled substances. I do not fall under these categories but still I'm a little concerned because now I live in South Carolina and for me to go back to NYC and have to even find the which courts to pay my fines would be pretty difficult for me to do since I have just started a new job. I would apperciate if anyone could bring some light to this matter for me. Thanks.

I think you're pretty safe. None of your offenses are felonies, none of them affect IMBRA.

And welcome!

Would it matter if either were felonies as long as there was not 3 drug charges or violent cases?

It could, but the whole purpose of IMBRA is to protect immigrating women from violent acts or trafficking. If your felonies are for organizing prostitution or wholesale distribution or something, it's possible they could affect a petition. However, if it's something like having 31 oz of weed in two baggies instead of one, probably not so much.

I know this is the piece of advice that this crowd (including me, usually) likes to hear, but if you have a felony conviction at all I think it's wise to talk to an immigration attorney.

would mr B. Madoff still be elligible? non violent.. no drugs... plenty of $... His wife will likely divorce him soon...

Well, he can't really file yet unless he's met his intended 18 year-old hawt sexah bride within the last 2 years already. Otherwise he's going to have to schedule his "A Foreign Affair" bridal tour for roughly July 2159. ;)

Couldn't he file as a hardship; because of governmental intervention in his life causing him to be unable to visit

2159 will they have developed a viagra to make the whole body stand up erect cuz I think Bernie will need it. Of course after spending 150 yrs in prison he might not like girls anymore.

I'm going to disagree with those who said he was a monster and even those who think he should get all that time in jail. Personally, I think he should get a couple years in a resort to think about what he did wrong, but I don't think what he did was all that wrong. The folks who lost all that money were motivated by the same thing he was - GREED.

When I hear stories about 74-year-old grandmothers who lost everything I wonder how? If they were diversified wouldn't they still have other investments and/or assets? If they lost everything they were in it for the same reason he was - GREED!

He pulled a horrible scam on people, but I don't see how he's any different than the guy playing 3-card monte down the block. We have people out here who shoot, rape and rob others in their community and we can't hold them in jail over the weekend yet this guy who set up an elaborate scheme in which no one was injured, hurt, or even really unjustly victimized, he gets 150 years.

Is that justice?

So if he would've said, "leave ten horses here with me and when you return in five years I'll have 1,000 horses for you" but then ran off with all the horses, you think the old west judge would've sentenced him to hang? Or would he have just said to the folks who lost their horses "What the hell were you thinking giving this guy all your horses?"
