Thank you for your help. I got it, Your either file I-130 or I-129F for K3, not both. Am I right? Just to making sure :thumbs::star:

Lawyer not helping at all. She said I can do both if I want, but since I'm married and have kid I don't really need to. But she said it's up to me. What a waste of money!

You file the I-130 no matter what. If you WANT to file a K3, then you send the I-129F once you get the NOA1 for the I-130. You include a copy of the NOA1 with the I-129F. If you DON'T send the I-129F, then you're petition will be for a CR1 (if married less than two years).

Your lawyer is correct - if you send the I-129F then you have the option of taking whichever is approved first - the CR1 or the K3 - and abandoning the other.

The general consensus on this board is that the K3 is a waste of time. The K3 is only slightly faster than the CR1, if at all. The K3 beneficiary still has to apply for AOS after arriving in the US, which means waiting before being able to work, and adds considerably to the cost. The CR1 beneficiary gets the green card soon after arriving in the US. You're probably better off not bothering with the I-129F, and just going with the CR1.

I just re-read the bolded sentence above and realized that I don't really know how the process works - if you have the option of accepting whichever one is approved first, if that is done for you automatically. Someone with K3 experience may have more info on that. I just remember reading that people who've applied for K3's have ended up taking CR1's instead.

You have an attorney and come here asking for advice? Something wrong with this picture!

Just remember, life over there in VN is NOT real! Your money will be worth a LOT less once you get back over here. Back to reality, cowboy!

CR1 is the recommended route. It will save you some money by not having to go through the AOS step that a K3 would require.

She gets the greencard after she arrives.
