I am on an international student visa in Toronto which is going to expire in December 2006, originally from Pakistan. I recently got married to a US Citizen from Pakistan over here in Toronto. She filed I-130 with G325A and 2 photo graphs with form filling fee and copy of marriage certificate with her passport copy of all pages and birth certifcate (copy). This was filed on the 30th of June, 2006. She is probably going to receive NOA1 in the next week. We have everything prepared for I-129 which will be mailed as soon as NOA1 is received. Can you please tell me is there a possibility if I would be able to get through. Also is there anyone out there who is in the same situation or gone through a same situation.

I believe so. I downloaded the form from USCIS website day before yesterday and filled it up and had it signed by my wife. Isn't that the new one?

My question was that, I have heard alot of people having problems with Montreal Embassy, long wait times etc. I wanted to ask someone who had experience or any idea about Montreal Embassy that would they consider expediting the process if needed so that I can get the visa before december? Also you have to have to apply where your marriage took place so I believe that would not be Pakistan than.

I have heard of cases getting expedited (not necessarily in Montreal, though). I guess it depends on the reason why you need your case expedited.

If you got married in Toronto, then you will have your K-3 interview in Canada. If you end up going back to Pakistan (after December 2006), you can pursue the CR-1 instead.

The only cases in VJ that have been expedited (to a certain extent) are from the USCs who are in the military. Sometimes they get deployed so they need to speed things up before the spouse or fiance leaves the US. Have a look around the site and see if others have posted their experiences. But I think the reason for expediting cases have to be really good reasons.

I'm not done with the process yet. As you can see, my K-3 interview is scheduled for August 8. So far, things have been going smoothly for that visa. I just wished we had applied for it sooner (we didn't until we realized that the I-130 was taking its time getting approved at CSC). Having said that, once the I-130 was approved, things proceeded "normally". The only delay was getting a police certificate from Singapore where I lived for 1 1/2 years. That delayed us by a month because I had to meet the requirements of the Singapore Police in order for them to process my application for a certificate of no criminal conviction. I also made a minor mistake on the DS-230 form which set us back by three weeks. The CR-1 is actually on its way to the consulate in Montreal and should be getting an interview date soon.

Our K-3 timeline is, I think, average. The CR-1... not so much.

Timeline

You can also contact Canadian Immigration on how to change status from student to a visitor.

According to their website obtaining a Temporary Resident Visa by switching from student to visitor status is easy to do.

This would give you permission to remain in Canada while awaiting your visa approval.

If you are approved before your expiration date in Dec, you can ask the consulate to expedite your appointment based on your current visa's expiration date as well.

I went through Montreal and I think my timeline is pretty typical. Montreal is a pain in the butt to deal with. If you want to talk to them about anything I would suggest calling and even then they were never very helpfull with me. Whenever I called asking if my interview was scheduled they would always say you should be getting an interview letter in about 2 weeks which never was the case.

I wouldn't suggest emailing them because of the length of time it takes to respond. I have heard others getting emails back from Montreal in a few days though.

I don't think you would be able to move your case along any quicker. I'm not sure about this however maybe you could go back to Packistan and then just fly to Montreal for your interview? Other than that I would agree with StuckinCanada and see if you can have your student visa transfered to a visitor visa.

Yes I am looking into that. I don't know that how come Montreal Embassy has soo many cases. I believe that its the only embassy in WHOLE Canada to process Immigrant visas. Probably that makes it busy but for K-3 they should have a provision to make it quicker. Anyways, lets see what happens. I am pretty sure that there is no one among us who has been in the same situation (on student or other NIV visa in Canada).
