Do I need a cosponsor

Hi,

I am wondering if I need a cosponsor....

in 2007,2008 I did not meet the income requirements.... in 2009 I got a raise and make way more than is needed...Since they ask for 3 years tax return... Will I need a cosponsor? I sent out my I-129 in 2009

Timeline

You should be good to go if in the last tax return it shows you meet the requirements, the older ones are usually used to show stability.

Unless the consulate you're going through has a special rule about this.

Most Embassies/Consulates base their decision on your current earnings - which may/may-not match what is on your previous income tax return(s).

By all means - if you have the ability - it will not hurt to secure a co-sponsor. If the Embassy/Consulate determines your income alone is sufficient, they will return the co-sponsor's information.

Moving this to embassy/consulate forum, this is not an issue when filing the I-129F because I-134 is not filed with the I-129F, it is an issue at the time of visa interview.

Is now a US Citizen immigration completed Jan 12, 2012.

One more question, in the case I do not secure a cosponsor... but at the interview beneficiary is told that I do not meet income requirements, will I be given the opportunity to then get a cosponsor?

Often yes. But in the interest of time and effort - if you think this may come up - it is best to do so before it comes up, not after.

But again - from what you've described, your income (current income) meets (actually exceeds as you say) the minimum requirement so you should not have an issue. You're not in a terribly unique situation - it happens every day.

Folks in your position will want to keep and provide as many pay stubs as possible (to prove your current income level) and if possible, provide a letter of employment (don't be too concerned if you can not get one though since many employers will not).
