Name change confusion

Timeline

My fiancé and I are going to get married in Vegas, and the procedure is to not show a name change on the marriage license or certificate. I know that I, the USC, can put in a request in my local courthouse back in Idaho with no problem for a name change. However, how does the non-USC get his name changed?

We will not have time to get his SSN card before the wedding, but we're going to need it to add him to bank accounts and such when we're married and to show his new last name. Plus I don't understand what name to file on his AOS forms if we have no court order/marriage certificate showing a name change.

I have read other old threads and I am still confused. So confused... help please.

He is changing his name? To what? And if he is changing his name, what are you changing yours to? Usually men don't change their names when they get married.

I'm guessing you missed my two polls on this topic. :P His last name will be changing. Possibly mine. We don't have much longer to decide. But that's sorta besides the point here.

Can someone please help me with my question?

Timeline

My wife changed her name when we got married. That's the simple way. So he changes his when you marry in vegas and uses the marriage certificate as proof and does everything afterwards in his new name.

Our thought was to not have to go back and do name changes, so we married first and then did Social Security number, AOS, etc. in married name. No issues whatsoever.

As far as SSA is concerned with the name change; it would have to be legal in the state that you marry for the groom to change his name to the bride's name based on marriage. Otherwise, he would need a court ordered name change or an immigration document in that name.

C. Procedure - Immigration Document as Evidence of Legal Name

When issuing immigration documents, the Department of State and DHS issue them in the person’s legal name. The legal name is also generally the name in which the foreign passport was issued.

When an alien applies for an SSN card, presume the name on the immigration document is the legal name unless the applicant presents evidence of a legal name change (e.g., marriage) that occurred after the immigration document was issued.

In cases where an alien applies for a replacement SSN card and submits an immigration document showing a name that is different from the name on the prior Numident record, accept the immigration document as evidence of the legal name. In these cases, the prior SSN card may have been issued in a name that was not the NH’s legal name.

D5. Change of Name Because of Marriage

Lynn Perkins-Walker applies for a replacement SSN card because he is changing his name. He submits a marriage certificate showing his old name of Lynn Perkins, his date of birth, and his wife's name (Lesley Walker). Lynn and Lesley are both changing their last names to “Perkins-Walker.”

The marriage certificate is acceptable evidence for a legal name change because in the State where Lynn and Lesley married, marriage is an event when the wife may change her name to the husband's last name, the husband may change his name to the wife's last name, or they both may change to a new name.

Some States only permit the wife to take the husband's surname. If this were the case in this situation, Lesley could change her name to Lesley Perkins and the marriage document, if it meets the criteria of an identity document, can be used to support the legal name change. However, Lynn could not change his name without an additional legal name change document.

Nevada doesn't "disallow" a name change, it just does not issue such a thing at the time of marriage for either person. They only issue name changes with a separate application and only for Nevada residents. All the paperwork in Idaho for a name change asks for your residence in Idaho, and technically he does not have residence before even applying for AOS.

Read the EM that SSA put out for name changes due to marriage and divorce and the section on POMS that the EM updated RM 00203.210 that might clear things up.
