IMBRA does NOT prevent someone from filing additional petitions for a K-1 visa within two years of filing for one. It simply requires that the petitioner apply in a short letter for a waiver, and nothing else. It is not clear how the USCIS would deny the waiver, but in all cases of which I am aware, the second and sometimes third petitions have moved without any delay caused by the waiver request.

Yes, it can take USCIS up to two years to let the petitioner appeal the denial of a K-1. So it's necessary to push the system and hope for a quicker notice from USCIS. In a friend's case, it took 18 months and he got the notice just last week.

Yes, I used the wrong terminology. IMBRA doesn't prevent the petitioner from filing a K1 petition - ever. You can always file a petition. IMBRA places specific limits on consular officers, and these limits affect the petitioner.

The specific wording of the law prevents a consular officer from approving a petition unless the officer has verified that the petitioner has not filed two or more previous petitions, or had a petition approved in the previous two years. The law also allows the Secretary of Homeland Security to waive those limits, if justification exists to waive them. It also specifically disallows a waiver if the petitioner has a history of violent crime, except under extraordinary circumstances (self defense, etc.).

This is not true. At least one consulate HAS refused visas to some couples (and made life hell for others) whose relationships were 100% genuine. Furthermore, for MANY other reasons, beneficiaries can be found ineligible to receive a visa. Please refrain from making sweeping statements about the consular and visa-issuance process.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

noa2 Hard Copy: Sep 21-09 called CSC said not approved still pending in system (#######!!!!)

noa3 recvd: Nov 25-09 USCIS is reopening case NOA2 was issued in error.(Government Motion to Reopen)

RFE ( NOID) recvd: Dec 18-09 ask to give rebuttal on consulate finding regarding 1st petition

RFE sent: Dec 20-09 rebuttal submitted plus able to front load additional proof.

noa4 recvd: Dec 28-09 APPROVED FINALLY

NVC recvd: Jan 04-10

NVC left: Jan 12-10

Consulate Recvd: Feb 05-10

Packet 3 submitted: Feb 09-10

Packet 4 Recvd: April 16-10

Interview : May 12-10...PINK SLIP already on the table (2years 1week later)

What (not 'wut') can happen if they get denied depends on the reason they get denied (if they get denied in the first place).

Say, for example, a couple flat out lies and/or misrepresents themselves and the Embassy/Consulate catches it and denies it for that reason. Future visa applications (or spousal petitions) may have serious issues.

As an example... it all really depends.

It might be helpful to know if your friend has specific concerns. :thumbs:
