Ok people here it is.

Very good situation gone bad. Basically my fiance goes to the interview we didnt have an employment letter.

The embassy asks for one.

I had already resigned from my job to go to Bangkok to get her and see her family. So I now they get the letter and send it but it says my last day of work is today...

I got one from my new job which states that I start work in about 2 weeks.

So I send her both employment letters to take to the embassy.

Am I totally screwed or is this reasonable?

She is very very very upset... so am I :(

Changing jobs happens all the time. If it's a similar job in the same or similar industry I can't see it being an issue. Maybe attach a letter explaining that you planned the trip to occur between jobs. The truth is always the best answer.

Ok people here it is.

The lawyer should have told you to get the employment letter earlier, but was probably too busy. Then again....oh NM.

Promises of employment are NOT acceptable for the I-864 but this is not the I-1864. The consulate needs to make a judgement call, perhaps the letter promising employment is enough. As I understand, Bangkok does not accept co-sponsors. It leaves you not much choice but to present what you have in the best way possible and hope for the best.

We can help you here, but you need to fill out your profile. I assume you are a K visa since this came up at the interview. I was IR-1 and it still came up at the interview. They are being a little nuts in BKK with the income thing. If you got 221g, post it here. We'll all help you.

(I'm going for the IR-1 and blowing off the K-3. Even if it takes an extra couple months, it's worth it to not have to deal with USCIS again)

Note:

Please fill out I-130, wait 6 months for approval, then 3 more months for an interview. (Unless of course we've bombed your country into the stone age, then you qualify for expedited processing.)

Sorry guys first time here! This is a K1 visa. I am in Phoenix Arizona. The fiance is in Bangkok. Im not sure what else you need to know? Feel free to ask. This was her first interview yesterday. The refusal letter said they need employment letter, signed by petitoner, and proof of 2009 income (even though I gave them an e-verify number and my friggen pay stubs from last week)

They won't be checking anything online, so the e-verify is out.

If you read the Packet 3 checklist carefully under the 1-134 Affidavit of Support it asks for:

1) The Petitioner's (US citizen) last year's tax returns (2008).

2) A letter from the employer

3) A copy of the Petition's passport

It seems like the critical missing piece is that employment letter. As far as 2009 income, recent paystubs are acceptable so I would go back with those, and you could also supplement it with your bank accounts/house/insurance policy, etc.

It seems my solution is that I need a new employment letter from a new job since I resigned from my old. I need to get that asap. Correct? The whole point was to resign to have time to spend with her and vacation before starting new job but they wont let me do that :(

I think you will have to give them a copy of the most recent tax filing ( 2009) , the pay stubs & a current employment letter. They may accept the explanation of resigning from your job to go to see her & therefore the letter of future employment. The problem is that you will not be at the interview to explain unless they have changed the policy about allowing the USC to attend again.

I think you will have to give them a copy of the most recent tax filing ( 2009) , the pay stubs & a current employment letter. I suggest including a notarized letter from you succinctly explaining your financial situation in plain English. Those tax returns and an explanation of how you are going to prevent her from becoming a public charge are key. Include everything you can to back up your claim. Here's hoping it goes well for you.
