Filed: K-3 Visa Country: Mexico

I recently filed my visa application for a k-3 visa and yes I know all about the CR-1 /CR-2 type visas. Anyway... I filed the k-3 visa and I was expecting to get back a request to follow up with a I-129f. Instead what I got back is looking like the CR-1.

Now... heres my concern - is this for a k-3? How can I tell? What should I look for?

I specifically chose the K-3 for a handful of reasons that did not include wanting to go through the paperwork for the CR-1. No my wife does not intend to work when she arrives here.

Now if it is for the CR-1 this gives me another problem since I submitted G-325's for her and her daughter and this looks like it is only for her, if it is not for a k-3 then I need to file a new i-130 for her daughter as well dont i?

I attempted to contact the USCIS but that number seems like a giant run around and I could not for the life of me get to talk to someone. Will I have to make an Infopass appt to talk to someone alive?

Any help will be appreciated.

Thanks.

If you have not yet submitted the I-129f then no, you have not yet petitioned for the K-3. They're not going to request it. If you'd like to go that route then you need to send the I-29f with a copy of the I-130 NOA1 to the service center listed on the NOA1.

Please read the guides

You are not applying for a K3 or CR1. You are petitioning so that your spouse can apply for the visa at an embassy/consulate abroad. When you file the I130 petition, you have started the process leading to a CR1. There is no way to file an I130 and have USCIS know that you want to pursue a K3 (yes you can put it on the cover letter, but they do not read it). You file the I129F with the I130 NOA1 to start the K3 process
