Hi fellow VJers,

I just want to share my cousin's experience and need your advise.

She was issued a k1 visa last year feb.2008 to be exact. She went to the US to marry her fiance. But things didn't work out, so she decided not to marry him and she came back in her homecountry before her visa expires.

Now here is the question:

can she still apply for a k1 visa?

when can she apply if ever?

Yes she can

There is no time limit or waiting period. She should be prepared to explain the situation at the interview.

Just as a clarification, she has to be petitioned by a US citizen first, then with an approved petition she can apply for a K-1 again.

do you think, consuls will give her hard time since she she didn't marry her fiance despite of the intentions before?

They may give her extra questioning as to why she is being petitioned again, but if she left within the timeframe I think for the most part it will be asking things like why she didnt get married before, how she is sure this time, why a man from the US again...that type thing, to make sure she isnt just doing it to get into the country (though I think its great that she went back when she decided not to marry him, good for her following the rules! :D)

Yeah, she'll get extra points for following the rules the first time! Like above they will ask lots and LOTS of questions about why another American and why she didn't marry the first guy. But she didn't do anything wrong, everyone changes their minds sometimes! But she just needs to be prepared to answer their questions, which they will most certainly ask. They might also ask why she is getting petitioned again so quickly. Just make sure she is ready to defend herself.

I am thinking of the show "The Bachelor"... He changed his mind in front of millions... I think she has the right to change her,,,,

I don't know what you call a "hard time" She can plan on being asked about it, she should be prepared to tell the truth and answer the questions. Philipines is a high visa fraud country and they will certainly want to determine any future relationship is legitimate and not based on a desire for immigration benefits.

Strange, you had almost the exact same problem in this post:

Those answers will be same for your "cousin" that you were given.

Was there something specific you didn't understand?

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

This is about a dumb as CAN be. I will gladly answer your question if I know the answer. I do not presume I am being "tricked" when I read a question. I do not need to be tricked to give an answer. Silly me. My answer is the same, it does not matter for answering questions on VJ if you are sincere. And my judgement of you matters nothing to your future. But continue with the tricks and it WILL matter to the consulate and their judgement has a LOT to do with your future.

I checked the other post also. A bunch of VJs members gave you sincere answers and wished you best (and the answers were the same...DUH! You or your cousin makes no difference) Many of us here just want to pass on our experience to others in the same process we went through. We are "volunteers" so to speak, we do this because it interests us and we gain as well as give. We do not need to be tricked. But I gained some knowledge in the process.
